Once hailed as a Silicon Valley success story redefining consumer genetics, 23andMe has now been acquired by pharmaceutical giant Regeneron for $256 million — a price tag that raises eyebrows not for its size, but for what it includes: the genetic blueprints of millions of Americans.
The acquisition follows 23andMe’s March 2025 bankruptcy filing, an event that triggered a flood of panic among privacy experts, consumers, and legal analysts. At the heart of the concern? The question no one really wants to ask:
What happens to your DNA when the company that stored it no longer exists?
Now, that question has an answer. And it’s one that may change the rules of genetic privacy forever.
THE BIOTECH TRANSFER: WHAT’S REALLY BEING SOLD
Regeneron isn’t just buying a struggling company. It’s acquiring:
- One of the world’s largest privately held genetic biobanks
- Access to longitudinal consumer DNA records tied to names, ancestry, health traits, and behavior
- Infrastructure to run direct-to-consumer genome testing
- Research pipelines built on predictive health algorithms trained on real genetic samples
While the company insists that it will respect 23andMe’s existing privacy policy, that assurance has done little to ease public concern — especially as the scope of what was acquired includes not just anonymized datasets but infrastructure capable of linking genetic records to identifiable individuals.
THE PROMISE OF “NO SHARING” — UNTIL IT’S TOO LATE
23andMe’s privacy policy currently prohibits sharing genetic information with:
- Insurers
- Employers
- Law enforcement (without a warrant or court order)
- Public databases
It also allows users to request deletion of their data at any time — a feature that was heavily used following the bankruptcy announcement, with a surge in deletion requests spurred by warnings from figures like California Attorney General Rob Bonta.
But here’s the dilemma: Once data is copied, extracted, or studied, deletion is not retroactive.
“23andMe consumers could not have envisioned, or meaningfully consented to, their genetic data being sold or used for purposes outside of the original context to discover family heritage or genealogy,” said Suzanne Bernstein of the Electronic Privacy Information Center.
FTC, LAWMAKERS, AND WATCHDOGS SOUND THE ALARM
Following news of the acquisition, Federal Trade Commission Chair Andrew Ferguson declared that no buyer may retroactively alter 23andMe’s existing privacy framework. The agency has warned that any deviation could trigger federal enforcement or antitrust scrutiny.
But even with FTC oversight, privacy advocates remain skeptical — especially given the industry’s track record of quiet policy amendments, opaque data sharing, and ethically ambiguous research partnerships.
23andMe, under fire, claims it required all bidders in the bankruptcy process to legally agree to uphold the privacy policy. A court-appointed ombudsman has been tasked with reviewing the full implications of the sale, with a final report expected by June 10, 2025.
REGNERON’S INTEREST: MEDICINE… OR MARKETPLACE?
Regeneron’s statement about the acquisition frames the move as a healthcare opportunity, not a surveillance operation. The company’s Senior VP Aris Baras emphasized:
“We assure 23andMe customers that we are committed to protecting the dataset with our high standards of data privacy, security, and ethical oversight.”
But critics point out the obvious: Regeneron is not a data vault. It’s a pharmaceutical company. And that means its business model relies on targeted therapeutics, genomic research, and predictive health analytics — all of which benefit enormously from the type of long-range, population-scale genetic data 23andMe has spent over a decade collecting.
Add to this the value of machine learning models trained on this genomic dataset, and the acquisition begins to look less like a bailout and more like a strategic biotech asset grab.
THE FALLOUT: PRIVACY ISN’T JUST A SETTING — IT’S A PHILOSOPHY
This deal lands at a dangerous intersection:
- A bankrupt data-rich company
- A healthcare behemoth seeking expansion
- Weak federal genetic privacy protections
- Growing consumer mistrust
And in the middle? The most intimate identifier we possess: our DNA.
As Suzanne Bernstein of EPIC warned, without strong consumer data protections, even pledges of compliance mean little. In an era where biometric data, family trees, and predictive disease profiles are monetized at scale, consumers are often the last to know — and the least protected.
THE UNSEEN RISK: THE NEXT DATA GOLD RUSH
Beyond privacy, the deeper threat is future scope creep:
- What happens when a pharmaceutical company uses this dataset to model who gets sick — and what they’ll pay to stay healthy?
