In fiscal year 2024 alone, over 200 million cyber “events” were intercepted before breaching federal court local area networks — a staggering figure that underscores just how valuable and vulnerable the Judiciary’s digital systems have become.

“The Judiciary has had to respond to waves of highly sophisticated and persistent cyber threats… We continue to face unrelenting security threats of extraordinary gravity.”
What’s at Risk: The Black Box of the American Legal Engine
The PACER system is far more than a digital filing cabinet. It’s where sealed indictments, arrest and search warrants, classified affidavits, and national security-related filings reside. Many of these documents contain proprietary economic intelligence, names of cooperating witnesses, and real-time law enforcement operations. If compromised, they don’t just risk cases — they risk lives, agencies, and ongoing national security investigations.
Judge Scudder warned that PACER — built on aging code and a brittle password-based architecture — is now unsustainable due to its growing cyber exposure. He testified that his committee and independent experts agree the system must be entirely replaced with a modernized, secure platform built using agile software development, piloted in phases across multiple federal courts.
The Judiciary is currently collaborating with DOJ’s National Security Division, FBI cyber units, CISA, and the Office of the National Cyber Director to coordinate defensive improvements and probe deeper into past and ongoing cyber breaches.
Behind the Curtain: Prior Attacks Already Happened — And Were Buried
This isn’t a theoretical threat. In July 2022, then–House Judiciary Chair Jerry Nadler revealed during a public hearing that PACER had already been breached in 2020 by three hostile foreign actors, in an intrusion described as “startling in breadth and scope.” While the DOJ began a quiet investigation, much of the breach was withheld from public disclosure, and its true impact remains classified.
That historical breach — and Scudder’s testimony now — confirms a chilling reality: the U.S. federal court system has already been penetrated, and the threat hasn’t slowed. It’s intensified.
Where the Money Goes — and Where It Hasn’t
Scudder testified in support of a $74 million budget request for FY2026, part of which would be used to accelerate the PACER system’s overhaul and bolster cybersecurity defenses across the judiciary.
Some existing funds have already been used to:
- Implement multi-factor authentication across court systems
- Launch a four-phase identity credentialing overhaul
- Upgrade network monitoring and activity logging tools
- Invest in firewalls and endpoint protection to fight known intrusion techniques
But the concern remains: these upgrades are chasing an evolving threat, and current protections may not be enough.
