Arizona Man Sentenced to More Than 11 Years in Federal Prison for Sexual Abuse of Minor Involving Threats and Intimidation

ALBUQUERQUE, NEW MEXICO — A federal court has sentenced an Arizona man to more than eleven years in prison after determining he engaged in sexual abuse of a minor through the use of threats and intimidation, a case prosecuted under federal jurisdiction due to the location of the offense and the status of the victim.

Fernando Yatsatie, Jr., 48, an Arizona resident and a member of the Zuni Pueblo, was sentenced in U.S. District Court in New Mexico following his guilty plea to sexual abuse. Federal law provides no parole, requiring Yatsatie to serve the full custodial sentence imposed by the court.

According to court records, the offense occurred in August 2021, when Yatsatie unlawfully engaged in a sexual act with a minor victim while employing threats and intimidation to carry out and sustain the abuse. Prosecutors stated that the use of coercion elevated both the seriousness of the offense and the sentencing exposure under federal statutes governing sexual abuse crimes.

In addition to the prison term, the court ordered that Yatsatie be placed on fifteen years of supervised release upon completion of his custodial sentence. As part of the judgment, he will also be required to register as a sex offender, subjecting him to long-term monitoring and restrictions designed to mitigate risk to the community.

Federal officials emphasized that cases involving sexual abuse of minors are treated as among the most serious offenses in the federal system, particularly when intimidation or threats are used to overcome a victim’s ability to resist or seek help. Prosecutors stated that the sentence reflects both punishment and incapacitation, ensuring extended separation from the community.

The case was investigated by the Gallup Resident Agency of the Federal Bureau of Investigation Albuquerque Field Office, with assistance from the Zuni Police Department. Authorities credited coordinated investigative efforts with bringing the case to resolution.

The prosecution was handled by Assistant U.S. Attorney Nicholas J. Marshall of the U.S. Attorney’s Office for the District of New Mexico. Federal officials reiterated that individuals charged in such cases are presumed innocent until proven guilty, and noted that Yatsatie’s conviction resulted from a voluntary guilty plea.

Federal authorities stated that the outcome underscores continued enforcement efforts to address sexual abuse crimes involving minors and to ensure accountability in cases involving coercion and abuse of power.
