A federal grand jury has returned a multi-count indictment against a Tucson man accused of firing a handgun at a federal law-enforcement helicopter during an attempt to evade border authorities in southern Arizona.
Federal prosecutors announced that Patrick Gary Schlegel, 34, of Tucson, faces five federal charges stemming from a January 2026 incident that investigators say involved the transportation of undocumented migrants, armed flight from law enforcement, and gunfire directed at a federal aviation unit.
The indictment includes the following charges:
- Attempted Murder of a Federal Officer
- Assault on a Federal Officer
- Transportation of Illegal Aliens for Profit
- Possession of a Firearm by a Prohibited Person
- Additional related federal offenses connected to the incident
The charges were issued by a federal grand jury in Tucson, formally initiating the criminal prosecution.
Desert Encounter and Initial Flight
According to federal investigators, the incident began on January 26, 2026, when U.S. Border Patrol agents encountered Schlegel while he was allegedly transporting two undocumented migrants through the desert region outside Tucson.
Authorities state that Schlegel fled the scene to avoid apprehension, leaving the two individuals behind in the desert terrain.
Transporting undocumented migrants for financial gain is prosecuted under federal statutes targeting human smuggling operations, which often involve the movement of migrants through remote areas to avoid checkpoints and law enforcement patrols.
Second Encounter in Remote Desert Area
The following day, Border Patrol agents located Schlegel’s Dodge Ram pickup truck in a remote desert location.
Investigators say Schlegel again attempted to evade arrest by driving deeper into the desert before abandoning the vehicle and fleeing on foot.
Because the terrain made ground tracking difficult, authorities deployed a U.S. Customs and Border Protection Air and Marine Operations helicopter to assist in locating the suspect from the air.
Air and Marine Operations units are routinely used in border enforcement operations to provide aerial surveillance, pursuit coordination, and agent safety support in difficult terrain.
Gunfire Directed at Federal Helicopter
According to the federal complaint, while the helicopter was assisting ground agents in locating Schlegel, the suspect allegedly fired multiple shots from a .45-caliber handgun toward the aircraft and its pilot.
Law enforcement personnel on the ground returned fire during the encounter. Authorities report that Schlegel was struck in the leg and head during the exchange.
After being wounded, he was taken into custody by federal agents and transported for medical treatment.
No federal agents or aviation personnel were reported injured during the incident.
Federal Charges and Potential Penalties
The charges filed against Schlegel carry substantial potential prison sentences if convictions are obtained.
Under federal law:
- Attempted Murder of a Federal Officer carries a maximum sentence of up to 20 years in federal prison
- Assault on a Federal Officer carries a maximum sentence of up to 20 years in prison
- Transportation of Illegal Aliens for Profit carries a potential penalty of up to 10 years in prison
- Possession of a Firearm by a Prohibited Person carries a maximum sentence of up to 15 years in prison

The helicopter involved in the incident was part of U.S. Customs and Border Protection’s Air and Marine Operations division, a specialized federal aviation and maritime enforcement branch.

- High-risk suspect tracking in remote terrain

The investigation into the incident has been conducted jointly by U.S. Customs and Border Protection and the Federal Bureau of Investigation’s Phoenix Division, including the Tucson field office.
