Italy’s data protection authority, Garante, has officially banned the Chinese artificial intelligence platform DeepSeek from operating in the country, citing serious privacy concerns and a failure to comply with European data protection laws. The decision, announced on Thursday, follows DeepSeek’s assertion that it does not fall under the jurisdiction of the European Union’s General Data Protection Regulation (GDPR)—a claim that Italian regulators firmly rejected.
Regulatory Scrutiny and Investigations Underway
Garante has launched a formal investigation into DeepSeek’s data practices after the company failed to provide satisfactory responses regarding its handling of user information. Earlier this week, the watchdog had demanded that DeepSeek disclose:
- The specific types of personal data it collects.
- The purpose of data collection.
- The sources of such data.
- Whether it is stored on Chinese servers.
- The legal grounds for gathering and processing this data.
DeepSeek’s privacy policy explicitly states that user data is stored on servers located in China, a practice that has raised alarm among European regulators due to concerns over potential access by Chinese authorities and the lack of adequate protections for European users.
Garante further questioned whether DeepSeek engages in web scraping to collect personal information and whether users are adequately informed about how their data is processed. According to the Italian agency, the responses provided by Hangzhou DeepSeek Artificial Intelligence and Beijing DeepSeek Artificial Intelligence—the two Chinese companies backing the platform—were deemed “completely insufficient.”
Deepening European Investigations
The regulatory crackdown on DeepSeek is not limited to Italy. Authorities across Europe are ramping up scrutiny of the AI tool:
- Ireland’s Data Protection Commission (DPC) confirmed on Thursday that it has requested DeepSeek to clarify its data processing activities concerning Irish citizens. The inquiry will determine whether DeepSeek is violating GDPR regulations within the country.
- Belgium’s Data Protection Authority has also opened an investigation following a complaint filed by the Belgian consumer protection organization Testachats. The complaint alleges that DeepSeek is engaging in “illegal data transfers,” potentially exposing European users’ personal information to unauthorized third-party access.
Italy’s History of AI Privacy Crackdowns
This is not the first time Italy has taken decisive action against AI platforms over privacy concerns. In 2023, Garante temporarily banned OpenAI’s ChatGPT, citing GDPR violations. That ban was later lifted after OpenAI implemented stricter data protection measures and made compliance adjustments to its user transparency policies.
Italy’s latest move underscores its determination to enforce strict data privacy standards and protect citizens from potential AI-driven exploitation. The ban on DeepSeek signals a growing European resistance to AI firms that fail to meet regulatory requirements, particularly those headquartered in countries with controversial data governance policies, such as China.
DeepSeek’s Silence Raises Further Concerns
Despite the escalating regulatory scrutiny, DeepSeek has not provided any public response or clarification regarding its data handling practices. The company has yet to comment on the bans and investigations currently unfolding in multiple European nations.
With AI-powered tools becoming increasingly sophisticated and prevalent, European regulators appear poised to implement tougher measures against companies that do not adhere to the bloc’s stringent data protection laws. The case of DeepSeek serves as a stark warning to other AI firms operating in Europe without full transparency and compliance.
As investigations progress, the outcome of these regulatory actions could set a precedent for future AI governance across the European Union and beyond.
