WHAT HAPPENS WHEN YOUR DNA GOES UP FOR AUCTION?
The collapse of genetic testing giant 23andMe has now triggered an urgent investigation by the House Oversight Committee, citing national security concerns, privacy violations, and fears of foreign exploitation of America’s most personal data: its people’s DNA.
Following the company’s March 2025 bankruptcy filing, Committee Chairman Rep. James Comer (R-KY) demanded answers from co-founder and now-former CEO Anne Wojcicki, who abruptly stepped down amid the financial chaos. She’s been asked to testify at a congressional hearing set for May 6, with lawmakers demanding full transparency on how — and to whom — the company’s genetic database could be sold.
A BIOMETRIC TIMEBOMB
23andMe, once hailed as a pioneer in at-home genetic testing, holds the sensitive genomic data of over 12 million people globally, including detailed ancestry, health predispositions, and family lineage data. But following a catastrophic 2023 data breach that exposed records of at least 6.9 million users, including those of Jewish and Chinese descent, questions have intensified over how secure that data really is — and who now has access.
The risk isn’t theoretical. In the wake of bankruptcy, 23andMe’s assets — including its genetic library — are considered transferable, unless explicitly safeguarded. Chairman Comer warned that foreign adversaries, particularly China, could gain access through third-party front companies or indirect acquisitions.
“The potential harm…does not come solely from hostile foreign actors,” Comer wrote.
“Disclosure of individuals’ genetic data could be used to assess higher insurance premiums, restrict credit access, or fuel targeted advertising based on predisposition to specific medical conditions.”
CHINA’S BIODATA OBSESSION
This isn’t the first time China has been linked to America’s genetic data. Intelligence agencies have long warned of the Chinese Communist Party’s interest in biometric surveillance, with reports tying previous Chinese firms like BGI Group to efforts at collecting and mapping global DNA patterns — particularly from U.S. citizens and minority groups.
The risk now is that, through bankruptcy fire-sale conditions, that data may fall into the wrong hands without any formal breach — just a loophole in liquidation.
FTC WARNINGS — BUT ENFORCEABLE?
The Federal Trade Commission under the Trump administration already warned that any buyer must comply with 23andMe’s original privacy terms. But as any security analyst knows, once data is transferred, the chain of custody becomes fragmented. Add in international shell entities or offshore servers, and the trail goes cold fast.
There’s also no current mechanism to revoke genetic data once it’s been copied or backed up, especially when bankruptcy courts treat such data as assets rather than private health records.
Wojcicki, while no longer CEO, still serves on the board and retains executive access to sensitive internal records. The Oversight Committee has requested all documents related to the sale, transfer, or monetization of customer DNA and related family data.
FROM HEALTH TOOL TO SOCIAL CREDIT WEAPON
What makes this situation more chilling is the downstream use of biometric profiles. If sold or leaked:
- Insurers could adjust risk models based on predisposed conditions
- Credit firms might deny loans using algorithmic predictions
- Employers could screen candidates with genetic red flags
- Governments could build ethnicity-specific behavioral models
All while users — many of whom simply wanted to learn their ancestry — have no idea where their genetic blueprint now lives.
