TRJ CYBERSECURITY INTEL REPORT
Category: U.S. State Data Privacy Legislation
Features: Geolocation data sale ban, children’s data protections, comprehensive privacy enforcement, legislative precedent setting
Delivery Method: Legislative mandate — enforceable through consumer protection laws and AG oversight
Threat Actor: Data brokers, app developers, ad tech syndicates — profiting from anonymized yet re-identifiable tracking data across state lines
On May 28, Oregon became the second state in the U.S. to ban the commercial sale of precise geolocation data, signaling a significant shift in how lawmakers are starting to treat digital surveillance. The law, passed with overwhelming support in the state legislature, builds on Oregon’s comprehensive 2023 privacy statute and places hard restrictions on location tracking — prohibiting the sale of any data that pinpoints a person’s movements within 1,750 feet.
That distance isn’t arbitrary. It marks a clear effort to eliminate the resale of hyper-precise tracking that can follow someone from their doorstep to their doctor’s office, from private schools to reproductive clinics. This is digital invisibility restored — at least on paper.
THE SECOND DOMINO: MARYLAND STARTED IT, OREGON DOUBLED DOWN
While Maryland was the first state to pass a law banning precise geolocation sales, Oregon just became the first to enhance that precedent with a sharper threshold and stronger definitions. Notably:
- Oregon bans sales of location data under 1,750 feet precision
- Children’s data protections extend to those under 16
- Data brokers must now operate under new transparency and consent rules
This law doesn’t just reinforce the protections of COPPA (Children’s Online Privacy Protection Act); it extends them, bypassing the federal loophole that only shields children under 13. Oregon is telling the surveillance economy: “We see your loopholes, and we’re closing them.”
WHY THIS MATTERS: THE PROFIT BEHIND EVERY FOOTSTEP
Today, most mobile apps run quietly in the background of people’s lives — collecting data, sharing telemetry, and feeding it back to brokers. These brokers then sell aggregated geolocation profiles to advertisers, hedge funds, and even law enforcement, all without a warrant or the user’s clear consent.
What makes this law different isn’t just that it bans the practice — it targets the ecosystem that profits from it. Companies that rely on granular movement data for behavioral targeting, predictive modeling, or retail surveillance will now face serious compliance hurdles.
And this isn’t limited to tech giants. Ad networks, SDK developers, affiliate marketers, and third-party analytics firms will all be affected.
A SHIFTING NATIONAL LANDSCAPE
According to Consumer Reports analyst Matt Schwartz, the passing of Oregon’s bill could become a legislative accelerant. Similar bills are already being debated in:
- Maine
- Massachusetts
- Vermont
California — often seen as a data privacy pioneer — failed to advance a similar proposal, showing that even progressive states are vulnerable to heavy tech lobbying. But the cracks are forming. And once two states make a move, others start to follow — especially when public sentiment is heavily in favor of digital privacy.
“People are creeped out by having their precise location data tracked,” Schwartz said. “Lawmakers will take action to address that.”
THE BACKDROP: APP STORES AND THE CHILD SAFETY BATTLE
Coinciding with Oregon’s legislation, Texas passed a separate child-focused privacy law mandating that Apple and Google verify the ages of all app store users — a direct response to increasing concerns around digital safety, online grooming, and behavioral tracking of minors.
The bill reportedly moved forward despite a personal call from Apple CEO Tim Cook to Governor Greg Abbott. It echoes similar measures passed in Utah earlier this year, and signals growing momentum toward tech accountability at the parental level.
Texas Attorney General Ken Paxton stated the bill’s intent clearly:
“It’s about giving parents tools to make decisions for their own children.”
Over twenty states are now considering age verification mandates, signaling a growing pushback against what many view as corporate indifference toward child exploitation and digital addiction.
TRJ CONCLUSION: LOCATION IS THE LAST FRONTIER — AND THEY’RE LOSING IT
The business of surveillance doesn’t need your name to profit off you. It just needs your location. From that, it can infer who you meet, what your habits are, which causes you support, which clinics you visit, and how long you stay.
Oregon’s new law doesn’t just regulate data. It redraws the map — forcing a multi-billion dollar industry to back off from the human layer it’s been quietly selling for years.
As pressure builds across states, and Europe tightens its GDPR enforcement, the U.S. is now entering the next phase of the privacy war. One where “precise” isn’t just a technical term — it’s a constitutional boundary.
