TRJ Cybersecurity & Power Structures Report
Category: Digital Rights & Corporate Influence
Features: Regulatory Capture, Insider Movement, Conflict of Interest
Sector: Social Media Platforms, Data Privacy Enforcement
The lines between regulators and the industries they’re supposed to oversee just blurred again—this time at the highest levels of the UK’s data protection watchdog.
TikTok, already embroiled in a £12.7 million ($17.25 million USD) fine and multiple investigations by Britain’s Information Commissioner’s Office (ICO), has quietly recruited one of the agency’s most senior officials.
Stephen Bonner, the ICO’s deputy commissioner for regulatory supervision, is slated to join TikTok later this year as the company’s head of European data protection—a move that has triggered fierce backlash from digital rights groups and political observers alike.
Bonner was widely considered integral to the ICO’s regulatory enforcement operations, particularly in complex cases involving social media giants. His upcoming jump to TikTok—a company he was directly overseeing—has reignited calls to crack down on the “revolving door” culture that allows regulators to transition into roles with the very companies they previously scrutinized.
Context: The Ongoing Battle Between TikTok and UK Regulators
TikTok is currently appealing the £12.7 million fine issued by the ICO in 2023 for alleged misuse of children’s data. In parallel, the ICO has launched a new investigation into TikTok’s data collection practices involving minors—an inquiry described by the regulator as “major.”
While the ICO insists Bonner was not directly responsible for the initial fine or the recent investigation, it admitted that he was involved in preliminary stages of oversight before formally stepping back to avoid conflicts of interest.
Despite these reassurances, critics are unconvinced.
The Broader Issue: Regulatory Capture, Conflicts of Interest, and the Failure to Close the Revolving Door
Bonner’s departure isn’t isolated. It’s part of a larger, unsettling trend where senior regulators migrate into powerful roles at tech and social media giants after years spent inside oversight agencies.
Digital rights advocates argue this practice undermines public trust and risks “regulatory capture”—a well-documented phenomenon where regulators begin prioritizing corporate interests over the public good, either consciously or through cultural drift.
“Stephen Bonner’s move is the latest in a long list of cases where the ICO has failed to uphold decent standards of public life,” said Mariano delli Santi from the Open Rights Group.
“Civil servants should use their positions to pursue the public interest—not their own career goals.”
A joint investigation by Tortoise Media and BBC News earlier this year uncovered dozens of similar cases across the UK tech and finance sectors, raising concerns that enforcement agencies are increasingly being hollowed out by lucrative private-sector recruitment offers.
Politics and Missed Opportunities: How Parliament Abandoned Safeguards
In 2023, Baroness Jones of Whitchurch—then in opposition—proposed an amendment to the UK’s Data Protection and Digital Information Bill that would have prohibited ICO employees from working for companies they investigated during their tenure.
The amendment was intended to close the revolving door and prevent future conflicts of interest. However, after the Labour Party entered government, the proposal was quietly shelved.
“The Labour government failed to seize this opportunity,” delli Santi said.
“They ran on a platform promising integrity in public life—but when it came to action, they backed down.”
Baroness Jones, now a junior minister at the Department for Science, Innovation and Technology (DSIT)—which oversees the ICO—did not respond to requests for comment.
DSIT defended the ICO’s independence, stating:
“All current and former ICO staff are bound by statutory confidentiality rules and are accountable to Parliament.”
The Strategic Importance of Bonner’s Move
Industry observers warn that TikTok’s recruitment of Bonner is not just about talent—it’s a strategic maneuver designed to strengthen its defenses against future regulatory actions across Europe.
As TikTok faces mounting legal challenges over its data practices, having a former high-ranking regulator at the helm of its compliance operations could shift the balance of power in upcoming enforcement disputes.
This isn’t unusual in the tech sector—but the timing and optics in this case are particularly troubling, given the size of the fine involved and the fact that TikTok is still under active investigation.
TRJ Reality Check
This is the blueprint of modern influence.
Tech giants don’t just fight regulators—they absorb them.
Bonner’s move isn’t just another job change—it’s a signal that no enforcement body is immune to corporate influence. The same people tasked with protecting the public’s digital rights are now being recruited to safeguard the very systems they were supposed to constrain.
The public may see headlines about TikTok’s “commitment to privacy” as this hire is announced.
But beneath the surface, the message is far clearer:
The regulators are now part of the machine.
Key Takeaways:
- TikTok hires Stephen Bonner, former UK deputy privacy regulator, amid ongoing investigations and fines.
- Move sparks new debate over revolving door politics and regulatory capture.
- ICO insists safeguards were in place, but critics call it a systemic failure.
- Parliament previously considered banning such moves—but the proposal was abandoned.
- Raises deeper questions about the integrity of digital privacy enforcement across Europe.
