At the center of the crisis is the Public Access to Court Electronic Records (PACER) system — the digital backbone of U.S. federal case filings.
While PACER is designed to provide public access to court documents, it also houses sealed, restricted, and classified records tied to ongoing criminal investigations, national security cases, and sensitive civil matters.

On June 24, Judge Michael Scudder, chair of the Committee on Information Technology for the federal courts’ policymaking body, testified before Congress that the judiciary blocked roughly 200 million malicious cyber “events” in FY 2024 — an attack volume more consistent with nation-state–level targeting than random criminal activity.
“Given the information in the Judiciary’s control, we continue to face unrelenting security threats of extraordinary gravity,” Scudder told the House Judiciary Committee.
“PACER is unsustainable due to cyber risks and needs to be replaced with a more cyber-secure system.”
Scudder’s assessment confirms what cybersecurity professionals have long warned: legacy systems like PACER were never engineered to handle modern APT campaigns — especially ones aimed at compromising the integrity of judicial proceedings.

If PACER or related systems have been compromised at the depth feared, the consequences could extend far beyond disrupted court operations:
- Witness safety risks if identities tied to sealed cases are exposed.

Who’s Behind the Attacks?
Officials have not publicly attributed the intrusion. However, given the precision targeting and the nature of the records at stake, the leading suspicions are a foreign intelligence service or highly resourced APT group.
Historical targeting patterns suggest likely candidates include actors with a known interest in U.S. judicial proceedings — such as China (APT 40 / APT 31), Russia (APT 29 / Fancy Bear), or Iran (APT 42).
