The Justice Department has opened a sweeping civil rights investigation into United Parks & Resorts Inc., the parent company governing SeaWorld Orlando, Busch Gardens Tampa Bay, Aquatica Orlando, and several other branded parks across the country. Federal civil rights lawyers are examining whether one of America’s largest entertainment conglomerates has been excluding guests with disabilities from full access — not through hidden policies, but through rules imposed at the front gate.
According to the Justice Department, the probe was triggered by a series of complaints from guests who rely on rollator walkers, a medically necessary mobility aid that includes a seat for those who cannot stand or walk for long periods. Complainants reported that multiple parks owned by United Parks & Resorts prohibited the use of these devices inside the parks, effectively blocking entry for visitors whose disabilities make rollators their only safe method of mobility.
The allegations carry weight because, under Title III of the Americans with Disabilities Act, theme parks are considered public accommodations and must permit the use of “wheelchairs and manually powered mobility aids” — a category that explicitly includes walkers, canes, and similar assistive devices. Federal regulators highlighted this requirement directly in their notice to United Parks & Resorts, noting that public accommodations “shall permit” these devices in all areas open to pedestrian use.
The federal letter, sent to the company’s CEO and General Counsel and attached at the bottom of this report, lays out the contours of the investigation and cites specific concerns that UPR parks:
- Prohibited rollator walkers at SeaWorld Orlando, Busch Gardens Tampa Bay, and Aquatica Orlando.
- Required guests with disabilities to rent alternative mobility devices at additional cost.
- Imposed eligibility criteria that may screen out individuals with mobility-related disabilities, a direct violation of ADA regulatory standards.
The Justice Department underscored that even a minor restriction on mobility aids — if it blocks access or imposes extra costs — can constitute discrimination under federal law. The agency’s formal notice reveals that guests who depended on rollators could not independently access attractions, venues, or general park areas without submitting to substitute equipment that did not meet their medical needs.
The scale of the investigation is significant. United Parks & Resorts encompasses not only its flagship SeaWorld and Busch Gardens properties, but also Discovery Cove, Water Country USA, Adventure Island, Sesame Place, and Aquatica-branded parks. Federal civil rights enforcement applies across the entire portfolio.
The Department stated that it has not yet reached conclusions about the company’s compliance but emphasized that the investigation was formally authorized based on credible allegations of systemic discrimination. Investigators requested an urgent meeting with company representatives and demanded contact information for responsible personnel within one week of the notice’s issuance.
The federal scrutiny extends beyond mobility policies. The underlying question at the heart of the investigation is whether a theme park operator — one that markets itself as a family-oriented global entertainment brand — crafted rules that effectively excluded a class of disabled visitors. The allegations suggest that individuals with disabilities were left with two unacceptable choices: either abandon the equipment they rely on for safety or abandon the parks altogether.
If the findings confirm violations, the company could face injunctive orders, mandated policy changes, civil penalties, and ongoing DOJ monitoring. Federal investigators also signaled openness to hearing from additional affected individuals.
The complaint lines are now open, and the investigation is active. For thousands of guests with mobility disabilities, the outcome will determine whether the gates of these parks remain open — or closed — not by design of their attractions, but by the policies governing who is allowed to enter.
