ALBUQUERQUE, N.M. — A 35-year-old Carlsbad man is facing federal charges after allegedly firing a rifle at an Eddy County Sheriff’s Office deputy who was responding to a reported armed disturbance in October 2025.
According to federal court records, on October 19, 2025, a deputy was dispatched to the area of McKittrick and Hidalgo Road in Carlsbad after a witness reported that Dustin Alan Henley was standing outside a truck holding a firearm. As the deputy arrived in a clearly marked patrol vehicle, Henley allegedly fired a rifle at the vehicle. The round struck the engine compartment.
The deputy returned fire, striking Henley multiple times. Henley reportedly dropped the rifle and fled on foot before being taken into custody. He survived the exchange and was transported for medical treatment prior to his arrest.
Federal authorities charged Henley with being a felon in possession of a firearm and ammunition. Court documents indicate that Henley was legally prohibited from possessing firearms at the time of the incident due to prior felony convictions. Federal law bars individuals with qualifying felony records from possessing firearms or ammunition under 18 U.S.C. § 922(g).
A conviction on the current charge carries a potential penalty of up to 15 years in federal prison. Henley remains in custody pending further court proceedings. A trial date has not yet been scheduled.
The case is being investigated by the Federal Bureau of Investigation’s Albuquerque Field Office, Roswell Resident Agency, with assistance from the Eddy County Sheriff’s Office and Homeland Security Investigations. The prosecution is being handled by Assistant U.S. Attorney Grant Gardner of the District of New Mexico.
A criminal complaint is an allegation. The defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
