A federal court in Chicago has imposed a $50 million criminal penalty on a Chinese telecommunications manufacturer after investigators determined the company orchestrated a long-running campaign to steal proprietary technology from an American communications firm and use it to compete in the global digital radio market.
The case centers on Hytera Communications Corporation Limited, a China-based telecommunications company that federal prosecutors say built portions of its commercial radio product line using confidential research and engineering data taken from Motorola Solutions, a major communications technology company headquartered in Illinois.
According to federal court findings, Hytera recruited engineers who previously worked at Motorola and directed them to obtain proprietary technical materials without authorization, including confidential software source code and internal engineering documentation tied to Motorola’s digital mobile radio systems.
The activity began around 2006 and continued for years as Hytera sought to accelerate the development of its own communications equipment.
Motorola’s digital mobile radio technology had been developed through years of engineering research, system testing, and hardware-software integration, allowing the company to establish a strong position in the professional two-way radio communications industry. These systems are widely used by public safety agencies, emergency responders, transportation networks, utilities, and large industrial operations that require secure and reliable communications.
Investigators determined that Hytera used stolen materials from Motorola engineers to rapidly build competing products that could enter the global market at a significantly lower development cost.
By bypassing years of internal research and engineering work, Hytera was able to produce digital radio equipment that competed directly with Motorola systems in both commercial and government markets.
Federal prosecutors stated that the theft of proprietary engineering data allowed Hytera to short-circuit the development timeline for complex communications technology, giving the company an artificial competitive advantage in the international digital radio sector.
After a criminal investigation led by federal authorities, Hytera pleaded guilty in the U.S. District Court for the Northern District of Illinois to conspiracy to steal trade secrets.
U.S. District Judge John J. Tharp Jr. imposed the $50 million fine and placed the company under five years of probation, requiring Hytera to maintain a corporate compliance program designed to prevent future intellectual property violations. The company must also submit annual compliance reports to federal authorities as part of the probation terms.
During sentencing proceedings, the court determined that Motorola had suffered approximately $214 million in lost profits resulting from the theft and subsequent competition in the digital radio marketplace.
Those losses were addressed through earlier civil litigation between the two companies, which resulted in payments by Hytera that offset the restitution amount in the criminal case.
The criminal prosecution followed a broader investigation into the company’s activities and the actions of several engineers who had previously worked for Motorola before joining Hytera.
In 2021, federal prosecutors indicted seven Hytera employees accused of participating in the theft of Motorola’s trade secrets. The indictment alleged that those employees played roles in transferring confidential technical information to Hytera during the development of the company’s radio systems.
One of the engineers charged in the case, Gee Siong Kok, pleaded guilty in 2022 to conspiracy to steal trade secrets and agreed to cooperate with investigators. Kok is awaiting sentencing.
Arrest warrants remain active for the six remaining defendants, who are believed to be located outside the United States.
The investigation was conducted by the Federal Bureau of Investigation’s Chicago Field Office, with assistance from specialists within the Department of Justice’s Counterintelligence and Export Control Section, which handles cases involving foreign economic espionage and the theft of American technological innovations.
Federal investigators emphasized that trade secret theft involving foreign corporations has become a growing national security concern. Technologies developed by American companies often require years of research and billions of dollars in development costs, making them attractive targets for foreign firms seeking to accelerate their own product development.

Authorities say the Hytera case illustrates how insider access to corporate research can be exploited to transfer critical technology into competing foreign products.
The digital radio technology at the center of the case is widely used in mission-critical communications networks. These systems allow emergency responders, police departments, fire services, and other critical infrastructure operators to maintain reliable communications during emergencies.
Because of the importance of such systems to public safety operations, federal authorities closely monitor attempts to obtain the technology through unauthorized means.
The conviction and financial penalty imposed on Hytera represent one of the largest criminal sanctions tied to trade secret theft involving telecommunications technology in recent years.
Federal prosecutors stated that the case demonstrates the continued commitment of U.S. investigators to protecting domestic companies from foreign corporate espionage and unauthorized technology transfers.
