FLORIDA DOCTOR SENTENCED IN $3.1 MILLION MEDICARE SCHEME INVOLVING FALSE MEDICAL ORDERS FOR GENETIC TESTING AND DME

BOSTON — A Florida physician has been sentenced in federal court in Boston for making false statements tied to a multimillion-dollar health care fraud scheme involving medically unnecessary genetic testing and durable medical equipment billed to Medicare.

Simon Grinshteyn, 52, was sentenced on September 22, 2026, by U.S. District Court Judge Angel Kelley to four years of probation, including six months of home confinement, along with 400 hours of community service. He was also ordered to pay $3,160,809.43 in restitution.

Federal prosecutors had recommended a sentence of 18 months in prison followed by 18 months of supervised release.

Grinshteyn pleaded guilty in March 2026 to one count of making false statements relating to health care matters after being charged in January.

The criminal conduct occurred between February and June 2020.

According to federal prosecutors, Grinshteyn worked with a purported telemedicine company that sent him pre-populated medical records and doctors’ orders involving genetic testing and durable medical equipment, commonly referred to as DME.

The documentation made it appear that Grinshteyn had provided legitimate medical consultations to Medicare beneficiaries, conducted examinations, and would provide additional care.

That was not what occurred.

Grinshteyn generally did not contact the beneficiaries himself and did not have established provider-patient relationships with them.

Despite that absence of direct care, he signed medical documentation supporting orders for genetic testing and DME that federal prosecutors said were medically unnecessary.

The signed records were then used by laboratories and medical equipment suppliers to submit claims to Medicare.

Those claims resulted in Medicare paying more than $3.1 million for testing and equipment supported by false documentation.

The Grinshteyn case centered on documentation that prosecutors said was pre-populated before reaching the physician, creating records that falsely represented the existence of consultations and examinations.

Grinshteyn pleaded guilty to making false statements relating to health care matters, the charge underlying his September sentencing.

The sentencing was announced by officials from several federal agencies.

United States Attorney Leah B. Foley announced the sentencing along with Robert Coviello, Special Agent in Charge of the U.S. Department of Health and Human Services Office of Inspector General; Ted E. Docks, Special Agent in Charge of the FBI Boston Division; Justin Page, Acting Inspector in Charge of the U.S. Postal Inspection Service’s Boston Division; Kelly Lawson, Regional Director of the Boston Regional Office of the U.S. Department of Labor’s Employee Benefits Security Administration; and Christopher Silvestro, Special Agent in Charge of the Defense Criminal Investigative Service Northeast Field Office.

Assistant U.S. Attorneys Alexandra Brazier and Lindsey Ross of the Affirmative Civil Enforcement Unit prosecuted the case.

In Grinshteyn’s case, prosecutors established that the medical records and orders falsely represented patient interactions that generally did not occur.

The resulting claims were not insignificant. More than $3.1 million in Medicare payments were tied directly to orders bearing Grinshteyn’s signature.

The restitution order of $3,160,809.43 reflects the financial impact attributed to his conduct. Although prosecutors sought a prison sentence, Judge Kelley imposed probation, home confinement, community service, and restitution.

The sentence does not change the legal status of the criminal conduct.

Grinshteyn pleaded guilty, was convicted, and has now been sentenced.

The case is no longer an allegation.

It is a completed federal criminal prosecution involving false medical documentation, Medicare reimbursement, and more than $3 million in losses tied to medically unnecessary services and equipment.
