A former senior federal employee has pleaded guilty to carrying out an extraordinary fraud scheme that exploited his government position to obtain approximately $193.6 million in U.S. government funds, much of which was converted into gold, luxury real estate, watches, vehicles, cash, and other high-value assets.
David J. Rush, 49, of Ashburn, Virginia, pleaded guilty October 6 to executing the scheme, which federal authorities say relied on fabricated government authorities and the misuse of a position carrying an exceptionally high level of public trust.
According to court documents, Rush held a senior executive-level position at a federal agency and possessed a Top Secret/Sensitive Compartmented Information security clearance, commonly known as TS/SCI.
Prosecutors said Rush obtained that senior position in part by providing false information about his education and military experience.
Once in the position, Rush created fictitious government authorities that appeared to authorize the expenditure of government funds. Among the mechanisms identified in court documents was a fabricated Special Access Program, a designation associated with tightly restricted national-security activities requiring enhanced safeguards and limited access.
Rush used those false authorities to obtain U.S. government money for his own benefit.
Federal prosecutors determined that approximately $193,590,400 was fraudulently obtained through the scheme.
A substantial portion of that money was converted into high-value assets. Rush acquired hundreds of gold bars and directed approximately $145 million through wire transfers that were ultimately used to purchase luxury real estate, watches, and at least one vehicle.
The scale of the gold purchases alone was substantial.
When FBI agents searched Rush’s residence on May 19, 2026, investigators recovered 298 gold bars. Authorities determined that the bars had cost the government approximately $46 million.
Agents also recovered approximately $2,106,550 in cash, €104,795 in European currency, and numerous luxury watches.
Under the terms of his plea agreement, Rush has agreed to forfeit the 298 gold bars, the currency recovered from his residence, properties obtained through the fraud, and 30 watches, many of which were Rolexes.
He also agreed to forfeit two 2026 BMW Alpina vehicles. At least one of those vehicles was valued at approximately $172,000.
The property identified for forfeiture illustrates the extraordinary volume of government money prosecutors say was converted into tangible assets during the scheme. Gold, luxury real estate, high-end watches, vehicles, and large quantities of currency allowed millions of dollars in government funds to be transformed into privately controlled property.
The case also carries an additional national-security dimension because Rush did not occupy an ordinary government position. He held a TS/SCI clearance and served at the senior executive level, placing him in a position where the government entrusted him with sensitive responsibilities and access.
Authorities said Rush exploited that trust by creating fictitious government authorities that enabled him to obtain U.S. government funds for his personal benefit.
CIA Director John Ratcliffe said the matter was identified through an internal investigation and then referred to the FBI. Ratcliffe said Rush abused his position and violated the public trust placed in him, while crediting the FBI and Department of Justice for pursuing the case.
FBI Director Kash Patel said Rush admitted defrauding the government of hundreds of millions of dollars and using the proceeds for extravagant purchases. Patel said the prosecution demonstrates that a federal position, security clearance, or access to government resources does not shield an individual from criminal accountability.
Assistant Attorney General for National Security John A. Eisenberg said Rush fraudulently obtained approximately $194 million worth of government resources and converted the proceeds into real estate, jewelry, gold, and other valuable property.
Eisenberg also emphasized the potential damage to public confidence when someone trusted with sensitive government responsibilities abuses that position for personal enrichment.
First Assistant U.S. Attorney Theophani K. Stamos for the Eastern District of Virginia said Rush had been entrusted with government resources connected to the protection of the country but instead used that access for personal financial gain.
According to court documents, Rush exploited his own official authority and created fictitious internal government structures that appeared to justify the movement of federal money.
The fabricated Special Access Program is particularly notable because legitimate Special Access Programs are used to protect exceptionally sensitive national-security information and activities by imposing safeguards beyond those normally applied to classified information. Prosecutors say Rush created a false version of that type of authority and then used it to facilitate the diversion of government resources.
He is scheduled to be sentenced on January 28, 2027.
Rush faces a maximum sentence of 20 years in federal prison, up to three years of supervised release, restitution, forfeiture, and a potential fine. The federal judge assigned to the case will determine the final sentence after considering the U.S. Sentencing Guidelines and other statutory sentencing factors.
The prosecution is being handled by Trial Attorneys Kevin C. Hakala and Kathryn D. DeMarco of the Justice Department’s Counterintelligence and Export Control Section, along with Assistant U.S. Attorneys Raizza K. Ty, Gavin R. Tisdale, and Anthony T. Aminoff for the Eastern District of Virginia.
The investigation has not concluded with Rush’s guilty plea.
The Department of Justice said its investigation is continuing, and the Director of National Intelligence has requested that the Inspector General for the Intelligence Community open an investigation into the matter.
Under the plea agreement, Rush has agreed to forfeit hundreds of gold bars, currency, fraudulently obtained properties, watches, and two luxury vehicles. The final disposition of those assets will proceed through the forfeiture process.
