SAN FRANCISCO, CALIFORNIA — A 35-year-old OpenAI engineer has been arrested and charged with a federal offense after investigators alleged that he secretly installed an audio recording device inside an executive conference room used for highly confidential discussions involving artificial intelligence research, proprietary technology, government engagements, and corporate strategy.
Abdulrahman Alfozan, a national of Saudi Arabia, was arrested October 9, 2026, and made his initial appearance in federal court on October 13, according to the United States Department of Justice. He is charged with using or endeavoring to use an electronic, mechanical, or other device to intercept oral communications.
Federal authorities allege that Alfozan, who had worked as an engineer at OpenAI since July 2025, concealed a recording device behind a television inside an executive conference room at one of the company’s San Francisco buildings. The device was discovered by company personnel around September 30, 2026.
According to the criminal complaint, the recording device had been inserted into a USB port on the rear of the television and concealed using toilet paper. OpenAI determined that it had been installed around September 28 and that its stored contents were encrypted.
The location of the device raised significant security concerns because the conference room was regularly used for meetings involving sensitive corporate information. Investigators reported that discussions held there included proprietary research, product development plans, commercial relationships, business opportunities, technical capabilities, strategic priorities, and communications concerning government engagements.
The complaint also alleges that Alfozan was not authorized to access the executive conference room or participate in the meetings conducted there.
Surveillance footage collected from OpenAI’s internal closed-circuit television system allegedly placed Alfozan near the conference room on multiple occasions before the concealed device was discovered.
Investigators also examined digital activity preceding the suspected installation. According to the complaint, Alfozan used a productivity tool to search for information concerning OpenAI building addresses, meeting rooms, room capacities, meeting schedules, executive locations, and meetings involving external business partners.
Federal authorities identified additional activity associated with a chatbot account connected to Alfozan’s spouse. Investigators reported that the account shared multiple identifiers and technical attributes with Alfozan’s account.
Between September 24 and September 30, the associated account allegedly submitted inquiries involving the construction, customization, installation, testing, concealment, and remote operation of audio recording equipment.
The inquiries included methods for continuous audio recording, wireless connectivity, live audio monitoring, and encrypting storage media. Investigators also identified searches concerning the specific recording device discovered behind the television, including its custom header and unique media access control address, commonly called a MAC address.
The complaint does not establish that Alfozan’s spouse knowingly participated in any criminal activity. The account-related evidence forms part of the allegations investigators are using to establish how the suspected surveillance equipment was prepared and deployed.
The investigation identified another incident on October 5, when surveillance footage allegedly showed Alfozan entering the executive conference room and looking behind the television where the first recording device had been installed.
That same day, according to federal prosecutors, Alfozan left a bag unattended inside another room in an OpenAI building. Company security personnel subsequently examined the bag and discovered a second recording device resembling the first, along with Alfozan’s wallet and identification.
The discovery of two devices became an important component of the federal investigation. Authorities have publicly described the first device as installed inside the executive meeting room and the second as recovered from the unattended bag. The available announcement does not establish that the second device had been installed or used to record conversations.
Federal investigators have also not publicly established whether confidential conversations were successfully captured, whether any recordings were transmitted outside the company, or whether proprietary information was delivered to a foreign government or another recipient.
The case has attracted federal counterintelligence attention because of the sensitive research and strategic information discussed within the targeted meeting room.
FBI Director Kash Patel characterized the alleged conduct as a threat to American technological innovation and emphasized the Bureau’s responsibility to protect sensitive research and business information. He identified cooperation among the FBI, intelligence officials, and private-sector organizations as an important part of the federal response.
Jay Clayton, Director of National Intelligence, also addressed the arrest, connecting the case to federal efforts to protect advanced American technology and intellectual property from foreign threats.
Craig H. Missakian, United States Attorney for the Northern District of California, emphasized the national security implications of attempts to obtain proprietary technology from companies operating in Silicon Valley.
Federal officials have framed the investigation within broader efforts to protect advanced artificial intelligence development and safeguard sensitive American technology. Their statements emphasize the national security implications of attempts to obtain proprietary research and confidential business information.
Although the government has emphasized counterintelligence concerns, the publicly announced charge concerns the alleged unlawful interception of oral communications. The Justice Department has not announced a separate espionage charge against Alfozan.
The criminal provision involved is 18 U.S.C. § 2511(1)(b), which addresses specified conduct involving electronic, mechanical, or other devices used or intended for the interception of oral communications.
Federal law treats unauthorized interception of qualifying private communications as a serious offense because such activity can expose confidential business discussions, personal information, and other protected communications without the knowledge or consent of the participants.
The case also underscores the security risks created when an individual with legitimate employment access allegedly attempts to conduct unauthorized surveillance within a restricted corporate environment. Physical access to office facilities can provide opportunities to place concealed equipment in areas where discussions are expected to remain confidential.
In this investigation, the alleged use of a television’s USB connection demonstrates how ordinary conference-room equipment can become part of an unauthorized surveillance arrangement. The circumstances also illustrate why corporate security investigations may require examination of physical devices, access records, digital account activity, and surveillance footage.
If convicted, Alfozan faces a maximum sentence of five years in federal prison, a $250,000 fine, and up to three years of supervised release. Any sentence would be determined by the court after considering federal sentencing guidelines and applicable statutory requirements.
The prosecution is being handled by Assistant U.S. Attorney Nicolas Parker of the Northern District of California, with assistance from Trial Attorney Kate Tagert of the Justice Department’s National Security Division, Counterintelligence and Export Control Section.
The federal complaint details allegations involving concealed electronic surveillance, restricted executive meeting spaces, recorded digital inquiries, and the recovery of a second recording device. Those findings will be subject to examination through the federal judicial process.
Alfozan has been charged, not convicted, and is presumed innocent unless and until proven guilty beyond a reasonable doubt. The investigation remains focused on the alleged unauthorized interception of confidential communications inside OpenAI’s San Francisco facilities.
