VIRGINIA STATE SENATOR LOUISE LUCAS INDICTED IN ALLEGED $4.5 MILLION DRUG TRAFFICKING AND RACKETEERING ENTERPRISE

NEWPORT NEWS, VIRGINIA — Virginia State Senator Lillie Louise Lucas, 82, of Portsmouth, has been federally indicted alongside six other defendants in an alleged criminal enterprise involving marijuana distribution, money laundering, bribery, fraud, and firearms offenses. Federal prosecutors accuse the longtime legislator of using her position in state government to protect an illicit business operation and influence legislation for personal financial benefit.

An eight-count indictment, filed October 14, 2026, and publicly announced by the U.S. Attorney’s Office for the Eastern District of Virginia on October 22, identifies what prosecutors call the “Lucas Enterprise,” an alleged criminal organization involving family members and business associates. FBI Director Kash Patel described the investigation as involving an estimated $4.5 million scheme spanning approximately five years.

Lucas faces five federal counts: racketeering conspiracy, conspiracy to distribute and possess with intent to distribute marijuana, conspiracy to launder money, conspiracy to commit honest services fraud, and maintaining a drug-involved premises. The remaining charges in the indictment include additional drug-premises offenses, possession of a firearm in furtherance of drug trafficking, and wire fraud involving other defendants.

According to federal prosecutors, Lucas allegedly directed the acquisition and distribution of at least 100 kilograms of marijuana while supervising the movement and laundering of proceeds generated through the enterprise. Investigators allege that the operation involved her two daughters, Lisa Lucas-Burke and Theresa Lucas-Lamb, grandson Ryan Eichelberger, and several business associates.

The indictment also names Carlton Upton Jr., Prince Albert William Hudson III, and Tameka Johnson, bringing the total number of defendants to seven. Prosecutors allege varying levels of participation in the organization, with individual charges reflecting the alleged responsibilities and activities of each defendant.

Lucas has served in the Virginia Senate for more than three decades and has held the position of president pro tempore since 2020. She also chairs the Senate Finance and Appropriations Committee, which oversees major legislative responsibilities involving Virginia’s budget, taxation, and government expenditures. Federal authorities allege that she used the influence associated with those positions to shield the enterprise from criminal scrutiny and pursue legislation that could provide financial advantages to its participants.

The alleged business activities centered partly on VA Freedom Life, a company associated with The CBD Shoppe and The Cannabis Outlet. Lucas and Carlton Upton Jr., 54, of Chesapeake, were business partners in the operation beginning in 2019. Upton managed The CBD Shoppe and allegedly participated in efforts to obtain a recreational marijuana license that prosecutors claim would have benefited the enterprise.

In 2021, Lucas and her daughter Lisa Lucas-Burke opened The Cannabis Outlet in Portsmouth. Investigators allege that Theresa Lucas-Lamb and her son Ryan Eichelberger subsequently participated in acquiring marijuana, supervising distribution activities, and managing the establishment as part of the broader operation.

Federal prosecutors also identified financial transactions and business disclosures as central components of the investigation. On February 1, 2022, Lucas identified herself as president and chief executive officer of VA Freedom Life on a Virginia General Assembly Statement of Economic Interests.

In August 2022, Lucas allegedly paid $750,000 to acquire complete ownership of a business holding company associated with a co-conspirator’s anticipated recreational marijuana license. Prosecutors allege that she subsequently failed to disclose that ownership interest in required state financial reporting documents.

The indictment further alleges that Lucas met with the co-conspirator at her office within the Virginia Capitol complex to receive a partial repayment. Prosecutors claim she also communicated with legislators and other officials regarding the co-conspirator’s qualifications for a marijuana license, with the alleged arrangement involving a bribery payment connected to her assistance.

The case includes a separate federal fraud allegation involving Upton. According to prosecutors, he submitted materially false attestations in an April 2020 application for an Economic Injury Disaster Loan through VA Freedom Life. The application resulted in an $11,800 loan payment, which investigators have incorporated into the financial misconduct allegations.

Federal agents executed search warrants at The Cannabis Outlet and The CBD Shoppe on May 6, 2026. Investigators recovered marijuana and firearms from both establishments. The seizure forms part of the government’s investigation into alleged narcotics distribution and related firearms activity, although the firearms possession count is specifically charged against Eichelberger rather than Lucas.

The case involves the Racketeer Influenced and Corrupt Organizations Act, commonly known as RICO, which permits federal prosecutors to pursue alleged coordinated criminal activity involving an enterprise and a pattern of qualifying offenses. The indictment also includes federal drug conspiracy and financial crime statutes addressing narcotics distribution, money laundering, and alleged corruption involving public officials.

Attorney General Todd Blanche announced the charges alongside First Assistant U.S. Attorney Theophani K. Stamos and FBI Director Kash Patel. Federal authorities identified the alleged misuse of public office and the financial activities of the accused organization as central subjects of the investigation.

Assistant U.S. Attorneys Eric M. Hurt and Brian J. Samuels are prosecuting the case in the Eastern District of Virginia. The indictment is filed under federal criminal case number 4:26-cr-75 in the Newport News Division.

The prosecution places a sitting Virginia state senator and members of her family at the center of a federal racketeering investigation involving alleged drug distribution, business operations, financial transactions, and political influence. The indictment establishes the formal charges brought by the government, but the allegations have not been proven at trial. Lucas and the six other defendants remain presumed innocent unless and until their guilt is established beyond a reasonable doubt.
