This week, diplomats from around the world converge in Paris for what could become a pivotal moment—or a political footnote—in the global fight against unregulated commercial hacking tools. The Pall Mall Process, spearheaded by the French and British governments, aims to rein in the growing chaos surrounding Commercial Cyber Intrusion Capabilities (CCICs)—but faces resistance from the very actors profiting off the status quo.
The stakes? Whether powerful nations and private vendors can be convinced to stop selling, spreading, and abusing hacking tech that’s already been used to silence journalists, crush dissent, and fuel authoritarian regimes.
THE PROBLEM WITH POWERFUL TOOLS
Commercial hacking software—like Pegasus (NSO Group) and similar exploits—are being weaponized by oppressive regimes to:
- Spy on journalists and whistleblowers
- Target foreign diplomats and dissidents
- Infiltrate NGOs and opposition movements
- Circumvent democratic oversight and weaponize zero-day vulnerabilities
These tools are not theoretical threats—they’ve been used in active transnational repression campaigns, with confirmed abuses reported in Saudi Arabia, Mexico, India, Egypt, and the UAE, among others.
The market for these capabilities has exploded, and the lack of oversight has created a black-and-grey cyber economy where repressive actors can buy offensive tech off the shelf.
WHAT THE CODE WOULD DO
According to the draft agreement, participants are being asked to agree to a voluntary Code of Practice modeled after frameworks like the Montreux Document. The proposals include:
- Regulating the development and export of commercial hacking tools
- Imposing oversight on domestic use of CCICs
- Establishing vulnerability equity processes to prevent exploit hoarding
- Banning procurement from vendors involved in abusive or illegal activity
- Imposing penalties on individuals and companies who enable CCIC abuse
This isn’t just a PR move. If adopted and enforced, this framework would disrupt the financial and operational freedom of spyware companies and the states that empower them.
RESISTANCE FROM THE USUAL SUSPECTS
But not everyone is on board. Some of the most prolific exporters and users of CCICs—Israel, India, Austria, Egypt, and North Macedonia—refused to even participate in the original 2023 London conference.
Israel’s absence is especially notable. The country is home to two of the four companies sanctioned by the U.S. for cyber tool trafficking. While NSO Group and Israeli officials are said to be “engaging quietly” with the process, neither is expected to agree to the Paris proposals this week.
THE COST OF COLLECTIVE FATIGUE
Writing ahead of the summit, Pablo Rice of the Paris Peace Forum warned the gathering may become “a testament of collective fatigue” if progress stalls. Diplomats fear that if nothing binding emerges, the Pall Mall Process will be remembered not as a pivot point—but as a missed opportunity.
There’s a lot riding on this. The international trade in cyber weapons is outpacing regulation, oversight, and consequence. If Paris fails, it won’t be the failure of diplomacy alone—it will signal that commercial surveillance tech is now untouchable by democratic norms or international law.
The world is watching what Paris decides in the shadows.
If nothing changes, the next generation of surveillance repression won’t just be inevitable—it’ll be legitimized.
