The spyware market isn’t shrinking—it’s mutating. And the so-called “solution” cooked up by world powers in Paris? A polite piece of paper with no teeth.
One year after its inception, the Pall Mall Process—a diplomatic initiative co-led by the UK and France—held its second global conference last week, this time in Paris, with the goal of taming the commercial cyber intrusion industry (CCICs). But with every new summit, it’s becoming increasingly clear: the spyware market isn’t listening.
Instead, it’s expanding, evolving, and in many cases, actively being fed by the very same states that pretend to regulate it.
The Code of (In)Action
After months of diplomatic drafting and behind-the-scenes haggling, the process produced its first official deliverable: a voluntary, non-binding Code of Practice meant to serve as a framework for regulating CCICs—companies that traffic in the art of hacking, surveillance, and digital intrusion.
Twenty-one nations signed the code on Friday. Romania joined on Monday. But don’t expect industry-wide reform. This code doesn’t punish violators. It doesn’t blacklist abusers. And it doesn’t include the actual bad actors.
Even worse? The list of absentees reads like a warning label.
- The United States didn’t sign.
- None of the other Five Eyes members signed either (Canada, Australia, New Zealand).
- Countries with their own spyware scandals like Austria and Hungary did sign—though critics question whether their support means anything more than diplomatic face-saving.
A process built to reform the market can’t even guarantee commitment from its biggest intelligence partners.
Lethal Policy or Metaphor?
The real shock came not from a signature, but a statement.
At the Paris conference, JD Work, a cyber strategist from the U.S. National Security Council and former intel officer, stunned delegates by suggesting the U.S. may “kill” malicious cyber operators in the private sector. Yes, you read that right.
“We’ll kill them,” he said during a workshop on market abuse prevention.
The room froze. Was it metaphorical? Figurative? Or a glimpse into the real U.S. cyber playbook?
While the NSC offered no public clarification, Work’s past remarks point to a consistent theme: he believes lethal force will become a standard response to cyber threats. The only question is when that line will be crossed—and whether some believe it already has been, quietly.
What the Code Won’t Do
The Code of Practice might look good on paper, but it’s not touching the core of the spyware trade:
- No ban on exploit brokering.
- No limits on selling to authoritarian regimes.
- No penalties for companies enabling transnational repression.
That’s not a regulation framework. It’s a stage play.
“You can’t slap the same rules on spyware vendors as on exploit brokers,” said Alexandra Paulus from the German Institute for International and Security Affairs. And she’s right. But that’s exactly what this code tries to do—apply a generic bandaid to a bleeding surveillance industry.
Meanwhile, firms like NSO Group—long vilified for their role in journalist and activist surveillance—are quietly “engaging” with the process. Engagement doesn’t mean change. It means influence, buy time, and shape the narrative.
The Realist Breakdown
What we’re seeing is another global diplomatic exercise that pretends to rein in power without ever touching the source of it.
The spyware market isn’t broken. It’s functioning exactly as designed:
- Exploit global legal gaps.
- Sell to the highest bidder.
- Operate through proxies and “consultants.”
- Deny, deflect, and if caught—rebrand.
The real threat isn’t just the spyware. It’s the protection racket wrapped around it.
What Comes Next?
The next version of the Code—one targeted directly at industry—is where the war will get real. Not because it will work, but because it might finally draw the battle lines between compliant firms and rogue contractors.
But as one participant admitted, it could just push the worst actors underground, into shell firms, offshore havens, and black market alliances that are already flourishing.
And let’s be clear: spyware isn’t just about surveillance anymore.
- It’s a mercenary economy.
- A tool of repression.
- A shadow arm of geopolitics.
If governments were serious, they’d enforce hard bans, launch joint indictments, revoke licenses, and choke the market at its choke points—money, hosting, hardware, and international access.
Instead, we get voluntary pledges and diplomatic apologies.
