What happens when the rules of war don’t match the weapons of sabotage?
That’s the question Estonia now faces as it considers a historic new law that would give its Navy the authority to sink merchant ships—not in wartime, but in defense of subsea cable infrastructure threatened by covert operations in the Baltic Sea.
The proposed legislation, set for its first reading in the Riigikogu (Estonian Parliament) this week, represents a radical escalation in how one NATO member is responding to a new era of unacknowledged, deniable maritime warfare.
The Cable War Has Already Begun
The move follows a disturbing pattern: repeated breaks in critical undersea cables throughout the Baltic and North Seas. These cables aren’t just telecom lines—they’re the arteries of global finance, internet traffic, and NATO military communications.
While official statements hedge on the cause—hinting at accidents rather than Kremlin-directed sabotage—there’s an unspoken consensus among military observers: the “shadow fleet” is in motion.
Estonia and other Baltic allies began heightened military patrols in January, releasing a carefully worded joint statement condemning “negligent or malicious” actions against subsea infrastructure—but stopping short of attribution.
Translation? They suspect Russia, but can’t—or won’t—say it out loud. Because doing so would require a response.
Between Diplomacy and Deterrence
The proposed law would allow sinking a vessel after evacuation, only in “extreme cases”—scenarios where a merchant ship poses an immediate threat to lives or environmental catastrophe, said Grigore-Kalev Stoicescu, Chair of Estonia’s National Defence Committee.
But legal scholars and defense experts are sounding the alarm. In international waters, any act of force—even against a suspected saboteur—can trigger massive diplomatic fallout. Especially when the vessel has been evacuated and no longer presents an active threat.
“If I were the captain of a ship, how should I sink a vessel whose crew I evacuated myself?” asked former Estonian Navy Commander Jüri Saska. “It will create a major threat to the environment. It’s all very confusing.”
He’s not wrong. Sinking a non-combatant merchant vessel—even one acting suspiciously—could violate freedom of navigation treaties, trigger lawsuits, or spark geopolitical standoff.
Small Navy, Big Stakes
Estonia’s naval force is modest: just eight commissioned vessels, primarily designed for mine clearance and coastal patrols. While symbolically potent, it’s a fleet ill-equipped for sustained interdiction missions or offensive naval operations.
The real plan? Hope the allies show up. Stoicescu all but admitted it: “If a situation arises where our limited capabilities do not allow us to respond adequately, we will hope for cooperation with our allies: Finland, Sweden, Latvia and others.”
This legislation, then, isn’t about Estonia acting alone. It’s about sending a signal—a warning shot across the bow of Russia’s hybrid warfare strategy. A declaration that even the smallest NATO member won’t remain passive while its digital and physical lifelines are threatened.

What Estonia is doing is simple: redefining what constitutes an act of war. Because the battlefield has already changed.
Undersea cables are now front lines. Shadow fleets are weapons platforms. And the enemy doesn’t need to fire a missile—just sever a line beneath 100 meters of seawater.
The proposed law is messy. Risky. Politically explosive. But it’s a symptom of the world we’re already living in—one where hybrid warfare erases the line between peacetime and war, between merchant ship and hostile actor.
If the West can’t adapt its rules of engagement, it risks losing the infrastructure war before the first shot is even acknowledged.
