The Federal Trade Commission (FTC) announced Monday that it is suing the operator of Sendit, an anonymous messaging app, accusing it of illegally harvesting children’s data and tricking users into signing up for costly subscription services. The case, filed by the Department of Justice on behalf of the FTC, represents one of the most direct federal challenges to how social apps target young audiences while disguising profit motives behind digital smoke and mirrors.
According to the FTC’s civil complaint, Sendit’s parent company — Iconic Hearts Holdings, Inc. — and its CEO, Hunter Rice, systematically violated the Children’s Online Privacy Protection Rule (COPPA) by failing to notify parents or obtain verifiable consent before collecting data from users under the age of 13. The app allegedly pulled in children’s phone numbers, birthdates, photos, and linked usernames from platforms like Snapchat, Instagram, and TikTok, despite clear obligations under federal law to secure parental approval for such practices.
But the complaint does not stop at privacy violations. The FTC also accuses Sendit of running a deliberate subscription scam, designed to manipulate users — including children — into paying weekly fees of up to $9.99 for access to its so-called “Diamond Membership.” Investigators allege the company used fake messages generated by the app itself to lure users into believing that real people were attempting to contact them. To see who sent the messages, users were prompted to subscribe. Instead of receiving the promised information, subscribers were met with vague or entirely fictitious details — location tags, phone types, or, in some cases, data for senders who never existed in the first place.
“Sendit’s operator and CEO were well aware that many of its users were under the age of 13 and still failed to comply with COPPA,” said Christopher Mufarrige, Director of the FTC’s Bureau of Consumer Protection.
“At the same time, they manipulated many users, including children, into signing up for their weekly subscription service by sending fake messages and promising to reveal the identity of message senders but failing to deliver.”
The agency argues that Iconic Hearts knowingly ignored red flags. According to the complaint, the company regularly received complaints from parents, while users themselves reported their ages during signup. In 2022 alone, the app logged 116,000 self-reported users under the age of 13 — yet still collected and monetized their information.
The allegations extend beyond COPPA. The FTC claims the company’s practices violated the FTC Act, which prohibits deceptive business conduct, as well as the Restore Online Shoppers’ Confidence Act (ROSCA), a law intended to crack down on hidden fees and subscription tricks.
The agency’s description of Sendit’s tactics reads like a playbook for predatory monetization. Messages sent through the app included provocative or manipulative questions such as “have you done drugs” or “would you ever get with me?”. Once hooked, users were blocked from accessing the supposed sender information unless they purchased a subscription. Even then, the “reveal” was misleading: vague metadata in place of actual identities, or entirely fabricated sender profiles.
The case comes amid growing federal scrutiny of anonymous messaging apps, many of which are popular with teenagers but criticized for enabling harassment, bullying, and exploitation. While Sendit has marketed itself as a fun and harmless add-on for social platforms, federal regulators now argue its business model was built on a foundation of child surveillance and fabricated interactions.
Iconic Hearts has not yet issued a formal response to the lawsuit, and a spokesperson did not return requests for comment. The company now faces potential civil penalties, forced changes to its business practices, and heightened oversight if the FTC prevails.
For regulators, the case is about more than one app. It’s a warning shot to the broader anonymous-app industry, where subscription scams and unmonitored data harvesting have flourished in a largely unregulated corner of the internet.
