MAN CHARGED WITH ASSAULTING BIA OFFICER ON MESCALERO APACHE RESERVATION

Federal prosecutors say that is exactly what happened on the Mescalero Apache Reservation when a Bureau of Indian Affairs officer arrived to investigate reports of a man breaking windows — and instead found himself under assault.

According to court documents, on May 29, 2025, 23-year-old Dominic James Isaac Sandoval Peralta, an enrolled member of the Mescalero Apache Tribe, became violent when a BIA officer with the Office of Justice Services responded to the residence. Witnesses reported chaos before law enforcement arrived — yelling, agitation, and shattered glass — but the situation intensified the moment the officer stepped toward Peralta. The filings describe Peralta as erratic, loud, and uncooperative from the outset, a state that escalated within seconds as he advanced toward the officer in a confrontational stance.

What happened next was not a brief struggle but a sustained assault. Prosecutors say Peralta struck the officer in the head multiple times, creating a rapid, dangerous escalation that forced the officer to deploy his taser during the confrontation. Only after the electrical discharge was Peralta subdued and placed under arrest. The officer suffered physical contact assaults during the encounter, and federal law makes any violent resistance against a federal officer — including BIA law enforcement personnel — a serious offense with significant penalties.

Peralta now faces a federal charge for assault, resistance, and opposition of an officer of the United States resulting in physical contact. He will remain in custody pending trial, which has not yet been scheduled. If convicted, he could face a sentence of up to eight years in prison, a punishment that reflects both the severity of the assault and the jurisdictional weight of attacking a federal officer on tribal land.

Federal officials speaking on the case noted that assaults on BIA officers remain a persistent danger across Indian Country, where jurisdictional lines, geographic isolation, and limited manpower often place officers in high-risk encounters with little backup. When a call escalates this quickly, it exposes the everyday reality of frontline officers operating in remote communities — a reality the public rarely sees unless an incident breaks into federal court records.

The investigation was handled by the FBI’s Albuquerque Field Office with assistance from the Bureau of Indian Affairs, Office of Justice Services. Assistant U.S. Attorney James Dickens is prosecuting the case. Acting U.S. Attorney Ryan Ellison and FBI Special Agent in Charge Justin A. Garris announced the charges as the federal government resumed normal operations following the shutdown.

As always, the criminal complaint represents an allegation, not a conviction. Peralta, like any defendant, is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
