Tallahassee Man Indicted on Federal Charges for Alleged Threats Against the President and Federal Officials

A Tallahassee man has been indicted by a federal grand jury on charges connected to alleged threats transmitted through interstate communications targeting the President of the United States and other federal officials.

Federal prosecutors in the Northern District of Florida announced that Diego M. Villavicencio, 36, of Tallahassee, faces multiple federal charges following the indictment. The charges include two counts of interstate communication of threats, one count of impeding or retaliating against a federal official, and one count involving threats directed at the President.

Villavicencio appeared in federal court in Tallahassee for his arraignment before United States Magistrate Judge Martin A. Fitzpatrick. The case has been scheduled for trial on May 5, 2026, before Chief United States District Judge Allen C. Winsor.

According to federal prosecutors, the charges stem from alleged communications in which Villavicencio is accused of issuing threats toward federal officials. Interstate communication of threats charges are commonly used when threatening statements are transmitted through platforms or systems that cross state lines, including electronic communications such as internet-based messaging or social media platforms.

Federal law treats threats against the President and federal officials as serious criminal offenses due to the potential impact on national security and the protection of government personnel. Agencies responsible for protecting federal officials routinely investigate threats delivered through electronic communications, particularly when the statements suggest the possibility of violence.

Investigators from several federal law enforcement agencies participated in the case, reflecting the seriousness of the allegations. The investigation involved the Federal Bureau of Investigation, the United States Capitol Police, the Federal Reserve Board Protective Service, and the United States Secret Service.

These agencies regularly coordinate in investigations involving threats to federal officials or government institutions. Protective agencies such as the Secret Service and Capitol Police maintain specialized units tasked with identifying and investigating threats directed toward government leaders and facilities.

If Villavicencio is convicted on the charges, he faces potential prison sentences of up to five years for each count involving interstate communication of threats and the count involving threats against the President. The charge related to impeding or retaliating against a federal official carries a potential penalty of up to ten years in federal prison.

In federal criminal proceedings, sentencing decisions are determined by a judge after considering the statutory penalties associated with each offense, the federal sentencing guidelines, and the specific circumstances of the case.

The prosecution is being handled by Assistant United States Attorney Eric W. Welch.

Federal authorities emphasized that an indictment represents a formal accusation issued by a grand jury and is not evidence of guilt. As in all criminal cases, the defendant is presumed innocent unless and until proven guilty in a court of law.

The case will now proceed through the federal judicial process as prosecutors prepare for trial in the United States District Court for the Northern District of Florida.
