LEGAL PERMANENT RESIDENT INDICTED ON FEDERAL CHARGE OF ILLEGALLY VOTING IN 2024 ELECTION

COLUMBIA, S.C. — A federal grand jury has indicted a South Carolina man on allegations that he illegally voted in the 2024 election despite not being a United States citizen, according to federal prosecutors.

Ekam Monfum, 38, of Rock Hill, South Carolina, faces one federal count of illegally voting as an alien following an indictment returned by a federal grand jury in the District of South Carolina.

According to the indictment, Monfum entered the United States in December 2022 and later obtained lawful permanent resident status through marriage to a United States citizen. Federal authorities allege that despite holding legal permanent resident status, he was not a U.S. citizen and therefore was not legally eligible to vote in federal elections.

Prosecutors allege that a voter registration application was submitted in Monfum’s name through the South Carolina Election Commission’s voter registration system in August 2024. The registration process requires applicants to affirm under penalty of law that they are United States citizens and otherwise eligible to vote.

According to the indictment, Monfum subsequently voted in the 2024 election after completing the registration process.

Federal law generally restricts voting in federal elections to United States citizens. While lawful permanent residents are legally permitted to live and work in the United States indefinitely, they do not possess voting rights in federal elections unless they become naturalized citizens.

If convicted, Monfum faces a maximum penalty of one year in federal prison and a fine of up to $100,000. A federal arraignment is expected to be scheduled in the coming weeks.

Election integrity investigations involving allegations of non-citizen voting are investigated by federal authorities when evidence suggests a potential violation of federal election laws. Cases involving voter eligibility often center on citizenship status, registration certifications, and whether false information was provided during the voter registration process.

The investigation is being conducted by the FBI Columbia Field Office.

Assistant U.S. Attorney John Potterfield is prosecuting the case.

An indictment is merely an accusation, and Monfum is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
