In a San Antonio courtroom, the illusion of legitimacy finally collapsed. Carlos Fabian Velez, 54, a convicted sex offender already serving more than seventeen years for distributing child pornography, has now been stripped of what little pretense remained — his claim to American citizenship.
Velez pleaded guilty to unlawful procurement of naturalization, admitting that his citizenship was built on lies. When he completed his federal naturalization application, he swore under oath that he had never committed a crime for which he had not been arrested. The truth was the opposite. He knew that he had possessed, received, and distributed child pornography — crimes that violate not only federal law but the moral foundation upon which the naturalization process rests.
The offenses occurred within five years of his application, a window that federal law defines as essential to proving good moral character. It is a standard that separates those who earn citizenship through honesty from those who steal it through deception. Velez’s failure to meet that standard was not technical — it was fundamental.
In July, he pleaded guilty to falsifying his sworn statements, and U.S. District Judge Jason K. Pulliam sentenced him to time served. He remains behind bars, continuing to serve his 210-month federal prison sentence from 2023 for the original child pornography conviction. The denaturalization order now ensures that when his prison term ends, he will not walk out as a citizen.
“Obtaining American citizenship is the goal of so many who come to our great country, but we will do all we can to ensure those who commit crimes against children and then lie about it never receive the honor,” said U.S. Attorney Justin R. Simmons of the Western District of Texas. “My office will continue to preserve and protect the sanctity of the naturalization process, and we will aggressively prosecute those who seek to abuse it.”
Investigators say the case reflects a deeper enforcement shift: an alignment between the FBI, Homeland Security Investigations (HSI), U.S. Citizenship and Immigration Services’ Fraud Detection and National Security Directorate, and the Bexar County Sheriff’s Office — agencies now coordinating under Project Safe Childhood, the Department of Justice’s nationwide initiative against child sexual exploitation.
The joint operation didn’t just expose the falsehood that brought Velez citizenship; it reinforced the precedent that denaturalization is not symbolic — it’s judicial reclamation. When an individual lies about crimes of this magnitude, the oath that follows has no standing.
Velez’s downfall also highlights a critical aspect of federal immigration integrity: the moral character clause. It is not an arbitrary moral test — it’s the firewall against predation cloaked in bureaucracy. For years, Velez hid behind paperwork that painted him as worthy of belonging. But as federal agents cross-verified naturalization records with criminal investigations, the contradiction surfaced like a wound reopened.
What began as a background check evolved into a case study of systemic resilience.
