CLARKSBURG MAN PLEADS GUILTY TO THREATENING PRESIDENT DONALD TRUMP AND ICE AGENTS

CLARKSBURG, W.Va. — A North Central West Virginia man has pleaded guilty in federal court to making online threats against President Donald J. Trump and U.S. Immigration and Customs Enforcement (ICE) agents, according to the U.S. Attorney’s Office for the Northern District of West Virginia.

Federal prosecutors announced Thursday that Cody Lee Smith, 20, of Clarksburg, pleaded guilty to making threats to kill the President of the United States and to threatening federal law enforcement officers assigned to Immigration and Customs Enforcement.

According to court records, the investigation began on January 17, 2026, after the Harrison County Sheriff’s Office notified federal authorities that Smith had allegedly posted multiple threatening messages on social media.

Federal investigators said agents with Homeland Security Investigations (HSI) and U.S. Immigration and Customs Enforcement reviewed Smith’s Instagram account and identified multiple posts containing threats directed at President Trump, his supporters, and federal law enforcement personnel.

According to prosecutors, Smith also sent a direct Instagram message to Donald Trump Jr. on the same day that contained what court documents describe as a sexually violent threat directed toward the President.

The following day, investigators said Smith called the ICE tip line and threatened to kill ICE agents assigned to Clarksburg. Prosecutors said the threats also targeted the employee who answered the call and members of that employee’s family.

By pleading guilty, Smith admitted responsibility for making the threats charged in the federal case. He now faces a maximum sentence of five years in federal prison for threatening the President of the United States and up to 10 years in federal prison for threatening federal law enforcement officers. His sentence will be determined by a federal district judge after consideration of the U.S. Sentencing Guidelines and other statutory factors.

Threats against the President of the United States and federal law enforcement officers are prosecuted under federal criminal statutes designed to protect government officials and ensure the safety of those performing official duties. Federal authorities routinely investigate threats communicated through social media platforms, electronic messaging applications, telephone calls, and other interstate communication systems.

The investigation was conducted by Homeland Security Investigations, the U.S. Secret Service, the Federal Bureau of Investigation, the West Virginia State Police, and the Harrison County Sheriff’s Office.

Assistant U.S. Attorney Andrew Cogar is prosecuting the case.

U.S. Magistrate Judge Michael John Aloi presided over the proceedings.
