REPUBLIC MAN SENTENCED TO MORE THAN NINE YEARS IN FEDERAL PRISON FOR FIREARM OFFENSE

SPRINGFIELD, Mo. — A Republic, Missouri, man with multiple prior felony convictions has been sentenced to 110 months in federal prison for illegally possessing a firearm during an eight-hour standoff with law-enforcement officers.

Phillip Brad Curtis, 52, was sentenced by U.S. District Judge Beth Phillips to nine years and two months in prison, followed by three years of supervised release.

Curtis was prohibited from possessing a firearm because of prior felony convictions that include robbery, domestic assault, possession of a controlled substance, and unlawful possession of a firearm. His criminal history established that the latest offense was not his first conviction involving illegal firearm possession.

According to court documents, deputies with the Barry County Sheriff’s Office responded to a property near Aurora, Missouri, after receiving a report that Curtis was trespassing.

When deputies arrived, they determined that Curtis had multiple active felony warrants for his arrest. The encounter developed into a standoff after Curtis threatened to kill the responding deputies, announced that he had a gun, and displayed a firearm from a window.

The standoff continued for approximately eight hours as officers worked to take Curtis into custody. He was eventually arrested without further incident.

Law-enforcement officers searched the residence and recovered a firearm concealed inside a dog-food bag.

Federal law prohibits individuals convicted of qualifying felony offenses from possessing firearms or ammunition. A conviction for being a felon in possession of a firearm does not require proof that the weapon was fired during the offense. Possession of the firearm itself is sufficient when the government establishes the required legal elements.

The circumstances surrounding Curtis’s arrest added a serious public-safety dimension to the offense. His threats against deputies, display of the firearm, active felony warrants, and refusal to surrender resulted in a prolonged armed confrontation that placed responding officers and others near the property at risk.

Following his release from prison, Curtis will remain under federal supervision for three years. Supervised release is a separate portion of the sentence that begins after incarceration and can include court-ordered conditions governing travel, firearm possession, reporting requirements, and contact with law enforcement. Violating those conditions can result in additional federal penalties or a return to custody.

Assistant U.S. Attorney Jessica R. Eatmon prosecuted the case for the Western District of Missouri.

The FBI, Bureau of Alcohol, Tobacco, Firearms and Explosives, Missouri State Highway Patrol, and Barry County Sheriff’s Office investigated the case.
