CLEARWATER MAN SENTENCED TO 10 YEARS IN FEDERAL PRISON FOR TRANSPORTING AND POSSESSING CHILD SEXUAL ABUSE MATERIAL

TAMPA, Fla. — A Clearwater man has been sentenced to 10 years in federal prison after admitting that he used Telegram to distribute and sell child sexual abuse material over a period spanning more than a year.

Brian Francis McArdle, 34, of Clearwater, was sentenced by U.S. District Judge Virginia M. Hernandez Covington for transportation and possession of child sexual abuse material, commonly referred to as CSAM. McArdle pleaded guilty on March 9, 2026. U.S. Attorney Gregory W. Kehoe announced the sentence.

According to court documents, McArdle used Telegram from January 1, 2023, through April 2, 2024, to distribute and sell CSAM involving minors engaged in sexually explicit conduct. The conduct was not limited to passive possession of illegal material. Federal prosecutors established that McArdle actively transported and distributed the material through the messaging platform during the charged period.

The investigation led authorities to execute a search warrant, during which the FBI examined McArdle’s cellular phone. Investigators located hundreds of images and videos containing CSAM on the device. Some of the material depicted a child younger than 12 years old engaged in sexually explicit conduct.

The volume and nature of the material recovered from the phone formed a central part of the federal case. Digital platforms and messaging applications can provide offenders with rapid methods for exchanging illegal material, while communications, stored files, device records, account information, and other digital evidence can become significant components of federal child-exploitation investigations.

McArdle’s conviction for transportation reflects conduct involving the movement or transmission of CSAM, while the possession count addressed the illegal material investigators recovered from his device. His guilty plea resolved the criminal charges without the need for a trial.

The case was investigated jointly by the Federal Bureau of Investigation and the Arlington County Police Department. Assistant United States Attorney Courtney Derry prosecuted the case for the Middle District of Florida.

The prosecution was brought under Project Safe Childhood, the nationwide Department of Justice initiative established in May 2006 to coordinate federal, state, and local efforts against child sexual exploitation and abuse. The program is led by U.S. Attorneys’ Offices and the Department of Justice Criminal Division’s Child Exploitation and Obscenity Section.

Project Safe Childhood coordinates federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children and to identify and rescue victims. Cases involving online distribution can require cooperation among federal investigators, local police departments, prosecutors, and digital-forensics personnel as investigators trace illegal material and determine how it was transmitted.

McArdle’s 10-year federal sentence follows his March guilty plea and the federal investigation that uncovered hundreds of illegal images and videos on his phone.
