BROWNSVILLE, Texas — A federal judge has denied a request to temporarily block a major land exchange between SpaceX and the U.S. Fish and Wildlife Service, allowing the transaction to move forward while a broader legal challenge continues.
U.S. District Judge Fernando Rodriguez Jr. of the Southern District of Texas denied the plaintiffs’ motion for a preliminary injunction on September 21. The court found that the plaintiffs had not established a substantial likelihood that they had standing and had not shown the irreparable harm required for emergency injunctive relief. The ruling does not resolve the underlying lawsuit on its merits.
The exchange involves approximately 715 acres of federal land associated with the Lower Rio Grande Valley National Wildlife Refuge and approximately 683 acres of privately owned SpaceX land that will be transferred to the federal government. The Fish and Wildlife Service says the acquired property includes higher-value habitat and will help consolidate fragmented refuge holdings in Cameron County.
The land being transferred to SpaceX lies near the company’s Starbase operations and includes property connected to the Boca Chica Tract. Roughly 700 acres of the federal property also sit within the Palmito Ranch Battlefield National Historic Landmark, according to the federal court’s September 21 order.
In exchange, SpaceX is transferring several parcels to the federal government, including land adjacent to or embedded within existing refuge property and approximately 476 acres next to the Laguna Atascosa National Wildlife Refuge.
The Fish and Wildlife Service described the acquired acreage as containing tidal marsh, saline prairie, thornscrub, coastal flats, wetland complexes, and shoreline habitat considered valuable for long-term conservation.
The agency has said the exchange is intended to reduce private inholdings, improve habitat connectivity, consolidate refuge property, reduce boundary conflicts, and improve management efficiency across protected lands in South Texas.
The legal challenge was brought by the Center for Biological Diversity, Save RGV, the Carrizo/Comecrudo Nation of Texas Inc., and the South Texas Environmental Justice Network. Their lawsuit challenges the Fish and Wildlife Service’s approval process and alleges violations of federal environmental, historic-preservation, wildlife-refuge, and administrative law requirements.
The plaintiffs sought to stop the land exchange while that litigation proceeds.
Judge Rodriguez declined to do so.
In his 27-page order, the judge concluded that the plaintiffs had not demonstrated the immediate injury necessary to justify preliminary relief. The court also found that the balance of equities and public interest weighed against issuing an injunction.
The court distinguished between potential future harm and the kind of immediate, non-speculative injury required for a preliminary injunction. Rodriguez wrote that the plaintiffs had presented comparatively weak evidence showing that the property would suffer environmental, cultural, historical, or aesthetic degradation during the period in which the lawsuit remains pending.
The ruling is therefore procedural rather than a final judgment that the Fish and Wildlife Service complied with every law challenged by the plaintiffs.
The plaintiffs’ underlying claims remain unresolved.
The case, Center for Biological Diversity et al. v. Nesvik et al., is pending in the U.S. District Court for the Southern District of Texas under Civil Action No. 1:26-CV-831. Space Exploration Technologies Corp., or SpaceX, is participating in the case as an intervenor-defendant.
The court also examined the conservation benefits asserted by the Fish and Wildlife Service.
According to the ruling, the Service presented evidence that the exchange would decrease fragmentation within the Boca Chica Tract and increase the size of the Laguna Atascosa National Wildlife Refuge. Those conservation benefits weighed against temporarily stopping the transaction.
The Fish and Wildlife Service’s own planning materials state that the exchange would place ecologically valuable or strategically situated properties under federal protection while transferring land the agency considers more likely to be affected by surrounding SpaceX development.
SpaceX has a separate interest in the transaction because the federal acreage borders its expanding South Texas operations.
The company operates Starbase near Boca Chica as a major development, manufacturing, testing, and launch site for Starship and Super Heavy. Portions of the exchanged land are located near SpaceX facilities, including the Massey test area and planned infrastructure associated with continuing development.
In considering the request for an injunction, the court found that a preliminary injunction would create uncertainty and require modifications to SpaceX’s development plans, placing additional hardship on the company’s ability to meet milestones and contractual obligations.
The Justice Department described the transaction as benefiting both conservation and national-security interests.
Principal Deputy Assistant Attorney General Adam Gustafson of the Environment and Natural Resources Division said the federal government will receive several hundred acres of high-quality habitat that the Fish and Wildlife Service seeks to protect, while SpaceX will receive land the government considers to have lower biological value and that can support SpaceX activities connected to NASA and the Air Force.
That statement reflects the government’s position in the litigation and should not be confused with an independent judicial finding that every exchanged parcel has a particular comparative biological value.
The Fish and Wildlife Service’s Final Environmental Assessment provides the underlying environmental analysis. The agency evaluated the approximately 715 acres proposed for federal divestiture against the approximately 683 acres being acquired from SpaceX and concluded that the exchange would improve the configuration and conservation value of federal refuge holdings overall.
The broader legal controversy centers on whether the Fish and Wildlife Service complied with federal law in the decision-making process that led to the exchange and whether the transaction itself satisfies the statutory requirements challenged by the plaintiffs.
The plaintiffs argue that the transferred property carries environmental, cultural, religious, and historical significance and that the Fish and Wildlife Service failed to comply fully with federal law when approving the exchange.
The federal government and SpaceX dispute those claims.
For now, the September 21 ruling removes the immediate legal barrier that could have stopped the exchange.
It does not terminate the lawsuit, invalidate the plaintiffs’ statutory claims, or establish that the Fish and Wildlife Service prevailed on the ultimate merits of the case.
The transaction can proceed unless another court order intervenes, while the broader dispute over the legality of the land exchange continues through federal court.
