TALLAHASSEE SERIAL FELON PLEADS GUILTY TO FEDERAL FIREARM CHARGE AFTER HOMELAND SECURITY TASK FORCE INVESTIGATION

TALLAHASSEE, Fla. – A Tallahassee man with multiple prior firearm convictions has pleaded guilty in federal court to possessing a firearm despite being prohibited from doing so, following an investigation involving Homeland Security Investigations, the Tallahassee Police Department, and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Malcolm Akeem Holloway, 22, of Tallahassee, Florida, pleaded guilty to possession of a firearm by a convicted felon.

The plea was announced by U.S. Attorney John P. Heekin for the Northern District of Florida.

Court documents show that the case developed in March 2026, when officers with the Tallahassee Police Department were conducting surveillance and observed Holloway carrying a backpack before entering the front passenger seat of a vehicle.

Police later stopped the vehicle for multiple traffic violations.

A law enforcement K9 alerted officers to the presence of illegal contraband, providing the basis for a search of the vehicle. Inside the backpack, investigators found clothing consistent with Holloway’s size along with a loaded FN 9 millimeter pistol that had previously been reported stolen.

Officers also discovered two plastic shopping bags containing a combined 65 taped, hand-rolled cigarettes. Court records describe the cigarettes as packaged in a manner commonly associated with attempts to introduce contraband into correctional facilities.

Investigators subsequently reviewed material from Holloway’s Instagram account covering the period from December 30, 2025, through March 2, 2026.

That review revealed multiple instances in which Holloway appeared in photographs or other social-media material posing with firearms. The firearm possession was prohibited because Holloway had already accumulated several state convictions involving weapons.

His prior record includes convictions for possession of a firearm by a delinquent, carrying a concealed firearm, three counts of possession of a firearm by a convicted felon, and possession of a machinegun.

Court records further establish that Holloway had most recently served a three-year prison sentence and was released on December 8, 2025.

His arrest occurred approximately three months after that release.

The timing is a significant part of the case because Holloway returned to firearm possession shortly after completing a prison sentence for prior criminal conduct involving weapons.

The loaded pistol recovered during the March traffic stop also had been reported stolen, adding another serious element to the conduct described in the federal case.

Holloway’s guilty plea moves the case directly into the sentencing phase.

He faces a maximum sentence of 15 years in federal prison.

Sentencing is scheduled for December 11, 2026, at 10:00 a.m. before U.S. District Judge Mark E. Walker at the United States Courthouse in Tallahassee.

U.S. Attorney Heekin said state and federal law enforcement agencies remain focused on removing dangerous, serial offenders from communities and using robust prosecution and incarceration against chronic offenders.

Heekin said his office intends to continue aggressively prosecuting dangerous and chronic offenders whose conduct presents persistent public-safety concerns.

The case also demonstrates how federal firearm prosecutions can build from local police activity.

The initial encounter began with surveillance and a traffic stop by Tallahassee officers. The recovery of the firearm, the stolen status of the pistol, Holloway’s prior felony record, and the additional social-media evidence then formed part of a broader federal investigation.

Homeland Security Investigations participated in the investigation alongside the Tallahassee Police Department, with assistance from ATF.

Assistant U.S. Attorney James A. McCain is prosecuting the case.

The prosecution is part of the Homeland Security Task Force initiative, which brings federal, state, and local agencies together in coordinated investigations targeting organized criminal activity, trafficking networks, violent offenders, transnational criminal organizations, and other cases falling within the initiative’s enforcement priorities.

In this case, the federal charge is centered on Holloway’s unlawful firearm possession following a substantial prior weapons history and his recent release from prison.

His guilty plea establishes criminal responsibility for the federal firearm offense, and the remaining question will be the sentence imposed in December.

The court will determine Holloway’s sentence at the December hearing under the applicable federal sentencing framework.
