ARIZONA SARMS DEALER SENTENCED TO FEDERAL PRISON AS COURT ORDERS COMPANY SHUTDOWN AND $1.8 MILLION FORFEITURE

PHOENIX, ARIZONA — A Phoenix businessman has been sentenced to federal prison, and his company has been ordered to cease operations and forfeit $1.8 million following guilty pleas involving the illegal importation and sale of unapproved substances marketed for muscle development and performance enhancement.

The U.S. Department of Justice announced on October 21, 2026, that Jeffrey McIndoo, owner and operator of JeffMac Investments LLC, doing business as SARMS Pharm LLC, received a four-month prison sentence and a $1,000 fine. U.S. District Judge Sharad H. Desai of the District of Arizona also ordered the company to shut down and forfeit $1.8 million in proceeds derived from its unlawful activities.

The prosecution involved selective androgen receptor modulators, commonly known as SARMs, a class of chemical compounds that interact with androgen receptors and can produce effects associated with anabolic steroids. These substances have been promoted for muscle growth and physical performance, but they are not approved by the U.S. Food and Drug Administration (FDA) for human use.

According to federal prosecutors, McIndoo admitted to introducing an unapproved drug into interstate commerce. His company separately pleaded guilty to participating in a conspiracy to smuggle SARMs from China into the United States. The admissions established criminal responsibility for the offenses addressed in their respective plea agreements.

Federal authorities determined that SARMS Pharm generated at least $3.5 million in gross profits from selling SARMs between 2017 and 2022. As part of its guilty plea, the company agreed to surrender $1.8 million in retained proceeds. The court ordered forfeiture of those proceeds as part of the criminal proceedings, rather than imposing a consumer restitution award.

SARMs have attracted regulatory scrutiny because products containing these substances are sometimes marketed as alternatives to anabolic steroids despite lacking FDA approval. Their potential health risks include liver injury, cardiovascular complications, and hormonal disturbances. The absence of FDA approval also means that these products have not undergone the regulatory evaluation required to establish safety and effectiveness for an approved medical use.

The case underscores the legal restrictions governing the importation, distribution, and marketing of unapproved drugs. Products promoted for research or performance enhancement are not exempt from applicable federal drug requirements simply because sellers describe them using alternative commercial terminology.

The FDA’s Office of Criminal Investigations conducted the investigation. Managing Attorney David Sullivan and Assistant Director Patrick Runkle of the Justice Department’s Civil Division, Enforcement and Affirmative Litigation Branch, prosecuted the case.

Assistant Attorney General Brett A. Shumate of the Justice Department’s Civil Division identified the illegal importation and distribution of unapproved products as the central public-health concerns underlying the prosecution.

The court’s decision brings the criminal proceedings against McIndoo and SARMS Pharm to sentencing, with the individual defendant receiving a custodial penalty and the corporate defendant facing the termination of its operations and substantial financial forfeiture. The case establishes federal criminal consequences for the company’s unlawful SARMs business and the importation practices admitted in its guilty plea.
