The bill, finalized and passed over the weekend, explicitly targets those operating on behalf of foreign governments — including state-sponsored hackers, embedded assets, and research infiltrators — and extends the legal reach beyond traditional state-secret leaks.
Now, sharing sensitive but unclassified information, conducting unauthorized research for foreign interests, or engaging in covert technological acquisition missions on Dutch soil is a prosecutable offense under national security statutes.
WHAT IT REALLY MEANS: SHIFTING FROM REACTION TO PREVENTION
“We must strengthen our resilience against attacks and threats from abroad,” said Justice and Security Minister David van Weel.
This law is more than symbolic. It represents a paradigm shift — from chasing breaches after they happen to legally enabling the preemption of espionage campaigns before they fully unfold.
With maximum penalties ranging from 8 to 12 years depending on severity and state affiliation, the Netherlands has rearmed its judiciary to address what intelligence analysts now agree is a silent war being waged through cables, code, and contracts.
And this isn’t an isolated reaction. It’s a state-level evolution in a broader European awakening to the cyber warfare age.
THE CATALYST: CHINA, RUSSIA, AND ACADEMIC INFILTRATION
The timing of this law is no accident.
In April, the Dutch government moved to tighten vetting processes for foreign researchers and students seeking access to sensitive technological sectors, citing persistent fears that China is using academic partnerships to exfiltrate military-grade innovation disguised as collaborative research.
This includes dual-use technologies — innovations that can be used for both civilian and military applications — often developed in top-tier Dutch institutions with deep EU research funding. Intellectual property siphoned through these “soft pipelines” has been traced back to Chinese defense labs, AI weaponization programs, and quantum research divisions.
But China isn’t the only concern.
Earlier this year, Dutch intelligence services released damning revelations that Russian state-sponsored hackers had attempted to sabotage Dutch critical infrastructure, targeting water systems, energy grids, and logistics coordination networks — key dependencies in both civilian life and NATO support operations.
These were not amateur probes. These were structured, command-linked attacks, confirmed to originate from known GRU units and FSB-controlled cyber branches.

The new law also arrives in the wake of direct digital attacks on international bodies based in the Netherlands, further pressuring lawmakers to act.
In recent months:
- The International Criminal Court (ICC) faced an attempted digital infiltration by a suspected Russian group amid rising tensions over war crime investigations in Ukraine.
- The Organization for the Prohibition of Chemical Weapons (OPCW) was also reportedly targeted by malware-laced phishing attacks and unauthorized network scanning efforts traced to foreign intelligence units.
Both institutions reside in The Hague, placing Dutch infrastructure at the epicenter of a global digital tug-of-war between justice and authoritarianism.
THE EXPANDED LEGAL NET: WHAT’S COVERED
The newly passed Dutch espionage law is designed to plug the gaps left by outdated statutes that only criminalized the theft of “state secrets.” Under the revised framework, the following now qualifies as criminal espionage:
- Transmitting unclassified yet sensitive information (e.g., scientific research, infrastructure layouts, or AI software frameworks)
- Acting on behalf of a foreign government in ways that harm Dutch sovereignty or commercial/strategic interests
- Engaging in covert cyber-operations targeting Dutch public or private sectors

- Attempting to gain insider access to critical infrastructure through recruitment or financial manipulation
