Alleged Kings Colony Shooter Facing Federal Firearm Charges Following Armed Confrontation

HOUSTON — Acting U.S. Attorney John G.E. Marck announced that Juan Ayala-Montero, 60, a Mexican national residing in New Caney, Texas, is facing federal charges for allegedly possessing a firearm while unlawfully present in the United States following a violent confrontation tied to an active shooter incident over Memorial Day weekend.

Federal authorities stated that Ayala-Montero is currently in custody on related charges and is expected to appear in federal court in the near future.

According to the federal criminal complaint, the investigation began following a May 23 active shooter incident in the Kings Colony area. Authorities allege that an argument escalated between Ayala-Montero and a group of individuals before he allegedly returned to his residence and retrieved an AR-style rifle.

Federal prosecutors stated that Ayala-Montero allegedly began firing rounds into the ground before directing gunfire toward multiple individuals at the scene. Authorities allege multiple shots were fired during the confrontation.

According to investigators, one victim suffered gunshot wounds to the torso and head during the incident.

Law enforcement responding to the scene allegedly heard continued gunfire coming from the residence while officers began evacuating and rescuing individuals in the area. Additional responding units later took Ayala-Montero into custody without further escalation.

Authorities stated that investigators recovered an Olympic Arms .223 caliber AR-style rifle equipped with a scope from Ayala-Montero’s bedroom along with approximately 30 spent .223 shell casings from the scene.

Federal authorities allege Ayala-Montero had previously been removed from the United States in 2006 and did not possess lawful authority to reenter or remain in the country. Prosecutors stated that federal law prohibits unlawful foreign nationals from possessing firearms or ammunition.

If convicted, Ayala-Montero faces up to 15 years in federal prison and a possible maximum fine of $250,000.

The investigation is being conducted by the Montgomery County Sheriff’s Office with assistance from the Federal Bureau of Investigation and Immigration and Customs Enforcement and Removal Operations. Assistant U.S. Attorney Anh-Khoa Tran is prosecuting the case.

Federal authorities noted that a criminal complaint is a formal accusation and that all defendants are presumed innocent unless proven guilty through the legal process.
