Federal Filing Describes Grok as Critical to Classified Operations and National Security Missions
MEMPHIS, Tennessee — The U.S. Department of Justice has moved to dismiss a Clean Air Act lawsuit filed by the NAACP against Elon Musk’s artificial intelligence company, xAI. In a striking intervention, the government argued that efforts to prevent xAI from operating the gas turbines would endanger American national, economic, and energy security by attempting to cut off power essential for AI innovation that aids the Department of Defense.
The lawsuit centers on xAI’s Southaven, Mississippi gas-turbine facility, located just across the state line from Memphis and used to power the nearby Colossus 2 data center. As the race to develop advanced artificial intelligence accelerates, companies are demanding enormous amounts of electricity, water, and cooling capacity to run their systems. To meet those energy demands, xAI turned to localized power generation.
The NAACP alleges xAI operated twenty-seven gas-fired combustion turbines without the required air permits at the Southaven Colossus Gas Plant. According to the complaint, the turbines emit harmful pollutants including nitrogen oxides, formaldehyde, particulate matter, and carbon monoxide, and the plaintiffs argue the facility is operating unlawfully without required Clean Air Act permits and controls. The NAACP contends these operations disproportionately burden Black and vulnerable communities in the greater Memphis area, exposing residents to serious respiratory and other health risks.
The National Security Argument
In a court filing this week, the Justice Department moved to intervene and seek dismissal of the lawsuit, arguing that cutting off power to xAI’s gas-turbine operation would threaten American national, economic, and energy security by disrupting artificial intelligence infrastructure that supports government and military functions. The filing is notable because it treats the infrastructure behind Grok not simply as a private commercial project, but as a strategic national security asset.
According to the DOJ memorandum, Grok is one of only four proprietary state-of-the-art artificial intelligence models capable of supporting national security applications and one of only three suitable for mission-critical operations across Secret and Top-Secret classified networks. The Justice Department further argues that disrupting the facility’s localized power supply could impair the deployment, refinement, and continued development of AI systems that federal agencies rely on for critical national security and operational missions.

Federal officials cited a Department of Defense declaration stating that Grok-enabled systems supported operations during “Operation Epic Fury,” the U.S. military campaign against Iran.
According to the filing, Grok-enabled systems aided the military in deploying over 2,000 munitions during the strikes. Because of this direct integration into combat operations, the Justice Department contends that the federal government maintains primary enforcement authority under the Clean Air Act, and that intervention is warranted to protect military capabilities.
The NAACP has firmly rejected these arguments. Representatives for the organization stated that the lawsuit seeks the enforcement of existing environmental laws, asserting that no company—regardless of its government contracts—should be exempt from compliance. The organization also accused the administration of attempting to limit the ability of local communities to challenge corporate pollution through citizen lawsuits.
Court records indicate the case remains active. A hearing on the NAACP’s request for a preliminary injunction is scheduled for August 24, 2026, and a federal judge has not yet ruled on the Department of Justice’s motion to intervene and dismiss.
