FIVE DEFENDANTS INDICTED IN GUAM FOLLOWING UNDERCOVER CHILD-ENTICEMENT OPERATION

HAGÅTÑA, GUAM — Five defendants have been indicted on federal charges of attempted enticement of minors following a coordinated undercover operation in Guam targeting individuals suspected of seeking unlawful sexual contact with children through online communications.

The investigation, known as Operation Protektot Y Famagu’on, or Defender of Children, was conducted from August 22 through August 27 as part of a Homeland Security Task Force effort focused on identifying suspected offenders using the internet to pursue sexual activity involving minors.

United States Attorney Shawn N. Anderson, serving the Districts of Guam and the Northern Mariana Islands, announced the results of the operation.

Federal authorities arrested five individuals who were later charged with attempted enticement of a minor under Title 18, United States Code, Sections 2422(b) and 2.

The defendants are Mike Ybanez Balbuena, 44, a citizen of the Republic of the Philippines; Eli Valentine, 21, an active-duty U.S. Navy service member; Keola Joaquin H. Flores, 30, a United States citizen; Peter John San Nicolas, 36, a United States citizen; and Augusto Bagat Anselmo, 44, a lawful permanent resident of the United States and citizen of the Republic of the Philippines.

The operation centered on coordinated online undercover activity within the District of Guam aimed at identifying individuals suspected of attempting to engage in unlawful sexual conduct with minors.

Federal law makes attempted enticement of a minor a serious felony carrying substantial mandatory penalties.

If convicted, each defendant faces a minimum sentence of 10 years in federal prison and a maximum sentence of life imprisonment. There is no parole in the federal system. Any sentence would be imposed by a federal district court judge after consideration of the federal sentencing guidelines and other statutory factors.

The investigation was led by Homeland Security Investigations Assistant Special Agent in Charge Guam with support from HSI Saipan, HSI Honolulu, HSI Atlanta special agents, the Naval Criminal Investigative Service, the Defense Criminal Investigative Service, the Federal Bureau of Investigation, and HSI Task Force officers assigned from several Guam law enforcement agencies.

Participating local agencies included the Guam Police Department, Guam Customs & Quarantine Agency, and Guam Airport Police.

The multi-agency structure of Operation Protektot Y Famagu’on brought together federal investigators, military criminal investigative agencies, and local law enforcement personnel in a concentrated six-day operation.

The prosecution is being handled as part of the Homeland Security Task Force initiative established under Executive Order 14159.

HSTF Guam includes personnel from Homeland Security Investigations, the FBI, Bureau of Alcohol, Tobacco, Firearms and Explosives, U.S. Customs and Border Protection, Coast Guard Investigative Service, Defense Criminal Investigative Service, Drug Enforcement Administration, IRS Criminal Investigation, Naval Criminal Investigative Service, U.S. Marshals Service, U.S. Secret Service, U.S. Postal Inspection Service, U.S. Citizenship and Immigration Services, and local law enforcement agencies.

The United States Attorney’s Office for the District of Guam and the Northern Mariana Islands is leading the prosecution.

The indictments are accusations only. Mike Ybanez Balbuena, Eli Valentine, Keola Joaquin H. Flores, Peter John San Nicolas, and Augusto Bagat Anselmo are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
