ROCHESTER, N.Y. — A federal jury has convicted a 42-year-old Libya native living in Colorado of threatening to murder two federal judges in Rochester after becoming angry over the dismissal of a civil case he had filed in the Western District of New York.
Akram Marseet, who resides in Golden, Colorado, was convicted of threatening two judges while they were performing their official duties. The offense carries a maximum penalty of 10 years in federal prison.
U.S. Attorney Michael DiGiacomo said the verdict reinforced the principle that members of the judiciary must be able to perform their duties without threats of violence or intimidation.
The case originated from a civil matter Marseet had filed in U.S. District Court for the Western District of New York. According to testimony presented at trial, a federal judge dismissed that case in January 2024.
On January 10, 2024, the U.S. Marshals Service received a report concerning a threatening telephone call placed to the Clerk’s Office for the Western District of New York. The threat involved individuals who fall under the protective responsibilities of the Marshals Service.
Trial testimony established that the caller identified himself as Akram Marseet, provided the number of his pending civil case and began discussing the proceedings. The court employee who answered the telephone had spoken with Marseet several times previously and recognized his voice. Marseet had also visited the clerk’s office on multiple occasions before the threatening call.
During the conversation, Marseet became highly agitated over the dismissal of his case and directed profanity and accusations at two judges. According to the evidence presented to the jury, he referred to the judges as criminals and threatened that if he encountered them, they would be dead.
The prosecution therefore centered on more than an anonymous or unidentified threat. The government presented evidence connecting Marseet directly to the telephone call through his identification of himself, his discussion of his own court case, the familiarity of the clerk with his voice and his prior personal appearances at the clerk’s office.
Threats directed at judges carry particular significance because federal judges routinely issue decisions affecting criminal defendants, civil litigants, corporations, government agencies and other parties whose interests may be directly affected by court rulings. The federal judicial process depends on judges being able to issue decisions based on law and the record before them without being subjected to threats intended to intimidate or retaliate against them.
The U.S. Marshals Service has a central role in protecting the federal judiciary and securing federal court operations. In this case, the Marshals Service became involved after the threatening call was reported and later participated in the investigation that resulted in Marseet’s prosecution.
The FBI and New York State Police also joined the investigation, bringing together federal and state law enforcement resources in the case.
Unlike an indictment or criminal complaint, the case has now passed through trial and resulted in a jury verdict. Marseet has been convicted of the charged threatening conduct, and the case will move to sentencing.
Assistant U.S. Attorneys Everardo A. Rodriguez and Katelyn M. Hartford prosecuted the case.
The investigation was conducted by the U.S. Marshals Service under the direction of Marshal Charles Salina, the FBI under the direction of Special Agent-in-Charge Allen D. Davis II, and the New York State Police under the direction of Major Kevin Sucher.
Sentencing is scheduled for February 1, 2027, before Chief U.S. District Judge Brenda K. Sannes of the Northern District of New York, who presided over the trial.
Marseet faces up to 10 years in prison when he is sentenced.
