FORMER FUGITIVE INDICTED FOR ATTEMPTED MURDER OF FEDERAL OFFICERS AFTER SHOOTING AT ARREST TEAM IN DAYTON

A federal grand jury has returned a six-count indictment against a Dayton man accused of opening fire on federal officers during an attempted arrest operation following years as a fugitive.

According to court filings, Terrence Gay, 41, of Dayton, Ohio, had been evading custody since September 2021 after failing to report to begin serving a federal prison sentence tied to fentanyl-related convictions. His status as a fugitive remained active for approximately five years before law enforcement located him in March 2026.

Investigators with the Southern District of Ohio Fugitive Apprehension Strike Team (SOFAST) developed intelligence on Gay’s location on March 19 and initiated surveillance at a residence believed to be under his control. On March 23, federal and local law enforcement units moved to execute the arrest, surrounding the property and announcing their presence and intent.

Authorities state that Gay refused to exit the residence and instead discharged approximately 12 rounds toward officers. The gunfire struck an unmarked Montgomery County Sheriff’s Office vehicle while deputies were positioned nearby. No injuries were reported, though the exchange elevated the operation to a high-risk containment scenario.

Following the gunfire, Dayton Police SWAT and Montgomery County SWAT units were deployed to secure the scene and assist in containment. During the standoff, communication was established through Gay’s legal counsel. A coordinated call involving United States Marshals led to negotiations that resulted in Gay surrendering without further violence.

The indictment charges Gay with:

• Attempted murder of a federal officer
• Assaulting federal officers with a deadly weapon
• Two counts of discharging a firearm during a crime of violence
• Possession of a firearm by a convicted felon
• Possession of a firearm while a fugitive from justice

Records indicate that, in addition to his prior federal convictions in Missouri, Gay has a criminal history in Montgomery County that includes aggravated robbery, theft, and kidnapping.

The case involves coordinated federal and local law enforcement efforts, including the Federal Bureau of Investigation (FBI), Cincinnati Division, the United States Marshals Service, the Montgomery County Sheriff’s Office, and the Dayton Police Department. The prosecution is being handled by Assistant United States Attorney Erica D. Lunderman.

An indictment constitutes a formal allegation. The defendant is presumed innocent unless and until proven guilty in a court of law.
