NEW YORK — Former Taliban commander Haji Najibullah, 50, of Afghanistan, was sentenced to 42 years in federal prison and five years of supervised release for his role in the kidnapping of an American journalist and two Afghan nationals, as well as providing material support for terrorist attacks that resulted in the deaths of U.S. servicemembers in Afghanistan.
Najibullah, who also used the aliases Najibullah Naim, Abu Tayeb, Atiqullah, and Nesar Ahmad Mohammad, pleaded guilty on April 25, 2025, to hostage taking and providing material support for acts of terrorism resulting in death. U.S. District Judge Katherine Polk Failla imposed the sentence on June 9, 2026.
According to federal authorities, Najibullah served as a Taliban commander in Afghanistan’s Wardak Province between 2007 and 2009, overseeing fighters responsible for attacks against U.S., NATO, and Afghan security forces. Prosecutors said forces operating under his command utilized improvised explosive devices (IEDs), rocket-propelled grenades, automatic weapons, and suicide attacks as part of Taliban operations during the insurgency.
One of the most significant attacks linked to Najibullah occurred on June 26, 2008, when Taliban fighters under his command ambushed a U.S. military convoy in Wardak Province using IEDs, RPGs, and automatic weapons. The attack killed U.S. Army Sergeants First Class Matthew L. Hilton and Joseph A. McKay, Sergeant Mark Palmateer, and an Afghan interpreter. Several additional servicemembers were wounded.
Federal prosecutors stated that Najibullah later claimed responsibility for the attack and told others that fighters under his command carried out the operation that resulted in the deaths of American troops.
Court records further show that Najibullah participated in the November 2008 kidnapping of an American journalist working for The New York Times and two Afghan nationals traveling with him. The hostages were abducted at gunpoint in Afghanistan and held for approximately seven months in Taliban-controlled areas of Pakistan.
During their captivity, the hostages were guarded by armed Taliban fighters and forced to participate in ransom and proof-of-life videos intended to pressure the United States government into releasing Taliban prisoners and meeting other demands. Prosecutors stated that the captives were repeatedly threatened with death during the ordeal.
The hostages ultimately escaped captivity and safely returned to their families.
Acting Attorney General Todd Blanche said the sentence demonstrates that individuals responsible for terrorism against Americans will continue to be pursued regardless of how much time has passed.
FBI Director Kash Patel stated that the FBI remains committed to locating and prosecuting terrorists responsible for killing or kidnapping Americans, emphasizing that investigators do not forget such crimes and will continue working with domestic and international partners to bring offenders to justice.
Assistant Attorney General for National Security John A. Eisenberg described Najibullah as a Taliban commander who oversaw fighters responsible for acts of terrorism that killed U.S. servicemembers and contributed to the Taliban’s violent insurgency campaign.
U.S. Attorney Jay Clayton for the Southern District of New York said the sentence holds a convicted terrorist accountable for crimes that resulted in the deaths of American military personnel and the hostage taking of civilians.
The investigation was conducted by the FBI’s New York Joint Terrorism Task Force with assistance from the Department of Defense, the Port Authority Police Department, the Department of Justice’s National Security Division, Ukrainian authorities, and the Justice Department’s Office of International Affairs.
The case was prosecuted by Assistant U.S. Attorneys Sam Adelsberg, Jacob H. Gutwillig, and David J. Robles, with assistance from Trial Attorney Jennifer Burke of the Department of Justice’s Counterterrorism Section.
