ALBUQUERQUE — An Albuquerque man has been charged with threatening to kill and decapitate an FBI special agent during a telephone conversation concerning firearms seized under a federal search warrant.
Alejandro Moya, 36, is charged with transmitting threatening communications in interstate commerce. The charge remains an allegation, and Moya has not been convicted.
According to court documents, Moya contacted the FBI’s Albuquerque Field Office on July 14, seeking the return of firearms seized during the execution of a federal search warrant in 2020.
During the initial call, Moya allegedly told FBI personnel that he was “tired of playing games” and demanded that his firearms be returned.
An FBI special agent contacted Moya by telephone later that day to discuss his request. During that conversation, Moya allegedly threatened the agent by stating, “Give me my fucking shit or I’m gonna kill you,” followed by, “I will fucking cut your head off.”
Moya allegedly continued making threats during the call, telling the agent, “You’re fucking dead.” He also allegedly challenged the agent to meet him at an Albuquerque residence for a physical confrontation.
Court documents allege that Moya knew he was speaking directly with an FBI special agent when he made the threats.
Moya made an initial appearance in federal court following his arrest. He was released on his own recognizance, meaning he was permitted to remain out of custody without posting a financial bond while the case continued.
His release does not resolve the charge or represent a finding concerning guilt or innocence. Defendants released on personal recognizance remain subject to court-ordered conditions and must appear for all scheduled proceedings.
Moya was scheduled to appear in court on July 20 for a combined preliminary and detention hearing. A preliminary hearing allows the court to determine whether probable cause exists to continue the federal prosecution. The detention portion addresses whether Moya should remain released or be held while the case proceeds.
If convicted, Moya faces a maximum sentence of five years in federal prison. Any sentence would be determined by a federal district court judge after considering the U.S. Sentencing Guidelines and other statutory factors.
First Assistant U.S. Attorney Ryan Ellison and Justin A. Garris, special agent in charge of the FBI’s Albuquerque Field Office, announced the charge.
The FBI’s Albuquerque Field Office investigated the case. Assistant U.S. Attorney Amy Mondragon is prosecuting the case for the District of New Mexico.
A criminal complaint contains allegations and does not constitute proof of guilt. Moya is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.

The language is bad enough but threatening to kill anyone is serious business. If found guilty, this man should face a stiff sentence. The maximum should be a consideration in this case.
A personal note on the language front: So many people have a bad habit of using foul language these days including politicians, former media “stars”, celebrities, and sports figures (including many coaches) that so many in the younger generation have followed suit. I’ve heard all kinds of swearing since I was a kid but I think things have gotten out of hand in recent years. I’m reminded of the words of Jesus:
“The good person out of the good treasure of his heart brings forth what is good; and the evil person out of the evil treasure brings forth what is evil; for his mouth speaks from that which fills his heart.”
A particular one that hits me sideways more than the other nasty things people say is when people use God’s name as a swear word.
“From a biblical and theological standpoint, the command ‘You shall not take the Lord’s name in vain’ means you should not use, carry, or represent God’s name in an empty, false, or dishonoring way.” (I agree with my computer AI here.)

I completely understand where you’re coming from. It’s sad how common that kind of language has become, especially when younger people hear it everywhere and begin believing it’s normal. I agree with you about using God’s name that way, too. That has always bothered me because His name deserves respect.
This is certainly a serious case, and if the charge is proven, the punishment should reflect the severity of those threats.

You’re welcome, John, and thank you for this reply. Your point about younger people hearing that kind of language is spot on. It appears to me that many people don’t even think about how they might “rub off” on youngsters by spilling out anything they choose.
Hopefully, this man will learn to deal with his anger in a more constructive way. I used to teach a Bible based anger management course to all kinds of people. Without the Bible verses, the course would not have been near as effective. Then again, you just never know. One of my former clients went out and killed his girlfriend. We had done all we could to help him, his anger management was court ordered, and it just didn’t penetrate. I pray that there is a different result in this case.
