ALBUQUERQUE — A Dulce man has been sentenced to 24 months in federal prison after admitting that he repeatedly struck a woman in the face and head while subject to a tribal court order prohibiting him from contacting her.
Shelton Atole, 35, an enrolled member of the Jicarilla Apache Nation, previously pleaded guilty to assault resulting in substantial bodily injury to an intimate or dating partner.
According to court documents, Atole attacked the victim on July 23, 2025, repeatedly hitting her in the face and head. The victim attempted to escape, but Atole chased after her as she fled.
The victim eventually managed to get away from Atole and contacted a friend, who picked her up following the assault. The attack caused substantial bodily injuries, resulting in the federal charge to which Atole later pleaded guilty.
At the time of the July assault, Atole was subject to a tribal court order prohibiting him from contacting the victim. The protective order had been issued after a separate assault involving the victim in June 2025.
Atole’s actions therefore involved a repeated act of violence committed approximately one month after the earlier incident and in violation of a court-imposed no-contact restriction intended to protect the victim.
The 24-month sentence will be served in the federal prison system, which does not provide parole. Upon completing his prison sentence, Atole will remain under federal supervision for three years. Supervised release can include court-ordered conditions governing a defendant’s conduct following release from custody, and violations can result in additional penalties or a return to federal custody.
First Assistant U.S. Attorney Ryan Ellison and Justin A. Garris, special agent in charge of the FBI’s Albuquerque Field Office, announced the sentence on Monday, July 20.
The Farmington Resident Agency of the FBI’s Albuquerque Field Office investigated the case with assistance from the Jicarilla Apache Police Department.
Assistant U.S. Attorney Meg Tomlinson prosecuted the case for the District of New Mexico.
