WASHINGTON, D.C. — A cybersecurity incident involving defense and technology contractor BAE Systems has disrupted a critical service used by federal bankruptcy courts throughout the United States, suspending the production and distribution of official bankruptcy notices and interrupting access to multiple judicial websites.
The Administrative Office of the U.S. Courts confirmed the disruption on October 15, 2026, identifying the Bankruptcy Noticing Center (BNC), a service operated by BAE Systems on behalf of the federal judiciary, as the affected system. The incident has interrupted both electronic and paper notification services used to communicate court proceedings and other bankruptcy-related information.
According to notices issued by several federal bankruptcy courts, the service interruption began on October 9, several days before the judiciary publicly confirmed that a cybersecurity incident was responsible.
The Bankruptcy Noticing Center serves a nationwide administrative function, preparing and distributing notices to debtors, creditors, attorneys, trustees, and other parties involved in federal bankruptcy proceedings. These communications can include case filings, scheduled hearings, creditor meetings, court orders, and other legally significant developments.
The affected systems include the Bankruptcy Noticing Center’s primary website, its bankruptcy notice services, electronic bankruptcy notification systems, and the National Creditor Registration Service. The latter supports centralized creditor address registration and access to information used in the delivery of bankruptcy notices.
The Administrative Office confirmed that access to the affected systems was unavailable and that the BNC had stopped producing and distributing bankruptcy notices. BAE Systems was investigating the security incident and coordinating restoration efforts with judiciary officials.
The disruption does not mean that every federal bankruptcy court has ceased operating. Several courts have confirmed that they continue accepting filings, opening cases, and processing documents through their existing electronic case-management systems.
The U.S. Bankruptcy Court for the Northern District of Texas stated that ordinary case processing would continue, although the delivery of court notices, orders, and notices concerning meetings of creditors could be delayed. The court also advised that judges may extend deadlines, reschedule hearings, or grant other procedural relief when the disruption affects parties involved in bankruptcy proceedings.
Similar guidance was issued by federal bankruptcy courts in Vermont, New Jersey, Georgia, Alaska, and Illinois, demonstrating the nationwide operational consequences of the contractor’s service interruption.
The federal judiciary uses the Case Management/Electronic Case Files system, commonly known as CM/ECF, to manage electronic court records and filings. Courts in several districts confirmed that CM/ECF remained operational, including its Notice of Electronic Filing email function for registered users.
The distinction between electronic case filing and bankruptcy noticing is operationally significant. Court personnel may continue receiving and processing case documents even when the separate contractor-operated service responsible for delivering official notices is unavailable.
In bankruptcy proceedings, timely notification can have substantial legal consequences. Creditors must receive information about cases that may affect their ability to collect debts, challenge claims, participate in proceedings, or respond to proposed court actions.
Section 341 of the Bankruptcy Code requires meetings of creditors, providing an opportunity for the trustee and eligible creditors to question debtors under oath about their financial affairs. Interruptions affecting notices of these meetings could create scheduling difficulties and require additional administrative action.
The disruption has also affected access to mailing matrices, which contain creditor names and addresses used to distribute bankruptcy documents. The U.S. Bankruptcy Court for the District of New Jersey acknowledged that some CM/ECF users could not access these records through the usual service and provided alternative procedures for obtaining creditor information.
In Alaska, the bankruptcy court reported that its electronic filing system remained functional while official notices to parties not registered for electronic service would be handled manually through the clerk’s office.
These contingency measures demonstrate that individual courts can continue essential judicial operations while attempting to compensate for the loss of centralized notification services. They also place additional administrative responsibilities on court personnel, attorneys, and other participants.
BAE Systems is a major international defense, aerospace, and security contractor with substantial operations serving government customers. Its involvement in federal bankruptcy administration demonstrates the broader role of private technology providers in maintaining government infrastructure beyond military and intelligence systems.
A cybersecurity incident affecting a contractor can interrupt services across multiple government institutions when those institutions depend on a common external platform. In this case, the affected service supports bankruptcy courts throughout the country, making the interruption a nationwide operational problem rather than an isolated courthouse outage.
The Administrative Office has not publicly identified the intrusion method, the individuals or organization responsible, or whether the incident involved ransomware, stolen credentials, compromised infrastructure, or another form of unauthorized activity.
There has also been no official confirmation that bankruptcy records, creditor information, or other sensitive data were stolen during the incident. The confirmed impact concerns the availability of the affected noticing systems and their associated services.
Determining whether information was accessed or removed would require forensic findings beyond the operational details disclosed by the judiciary.
The interruption highlights the importance of third-party cybersecurity controls, incident response coordination, and continuity planning for government services. Centralized systems can improve administrative efficiency, but their failure can affect numerous institutions simultaneously when essential operations depend on a shared provider.
For attorneys, trustees, creditors, and debtors, the immediate concern is whether court notices will reach their intended recipients and whether existing procedural deadlines remain enforceable during the disruption.
Bankruptcy courts have advised participants to monitor electronic case records and follow district-specific instructions. Some courts have indicated that parties should arrange alternative service for important or time-sensitive documents rather than relying on the unavailable BNC infrastructure.
Any extension of a filing deadline or modification of a scheduled hearing remains subject to the applicable court’s orders and procedures. The nationwide service interruption does not automatically suspend every bankruptcy deadline.
BAE Systems and the Administrative Office of the U.S. Courts are coordinating the response, with the contractor working to restore affected services.
As of the judiciary’s October 15 announcement, no nationwide restoration timetable had been established. The full technical scope of the incident, the potential exposure of information, and the duration of the operational disruption remained undetermined.
The confirmed outage demonstrates how a cybersecurity incident within a single government contractor can interfere with a critical administrative function shared across the federal judicial system, even when courts’ primary electronic filing operations continue functioning.
Administrative Office of the U.S. Courts — Essential. This is the primary confirmation of the cybersecurity incident affecting BAE Systems and the nationwide disruption. It is the strongest document. (Free Download)
Northern District of Texas — Highly valuable. Establishes the October 9 start of the service interruption, confirms that court operations continued, and documents potential delays, deadline adjustments, and alternative procedures. (Free Download)
District of Vermont — Valuable supporting evidence. Independently confirms the nationwide noticing disruption and establishes that the court’s CM/ECF electronic filing notification system continued operating normally. (Free Download)
