Landmark Second Amendment ruling challenges New York’s 2022 body armor restrictions as federal judge recognizes constitutional protection for defensive armor
BUFFALO, NEW YORK — A federal judge has ruled that New York’s prohibition on the purchase and sale of body armor by ordinary residents violates the Second Amendment, delivering a major courtroom victory to gun-rights advocates and establishing that protective armor falls within the constitutional right to keep and bear arms for lawful self-defense.
U.S. District Judge John L. Sinatra Jr. issued the 47-page decision on October 21, 2026, in Heeter v. James, a constitutional challenge brought by the Firearms Policy Coalition and individual plaintiffs Benjamin Heeter and Joseph Wurtenberg. The United States District Court for the Western District of New York granted summary judgment in favor of the plaintiffs, rejected the state’s competing arguments, and ordered a permanent injunction against enforcement of the challenged restrictions on purchasing and selling body armor.
The ruling directly challenges legislation New York enacted in 2022 following the mass shooting at a Buffalo supermarket, where the attacker wore body armor during the killing of 10 people. State lawmakers subsequently prohibited most residents from purchasing protective body armor unless they worked in designated professions, including certain law enforcement, military, and other approved occupations.
Under the restrictions, ordinary civilians seeking body armor for personal protection faced criminal penalties for purchasing the equipment, while businesses were prohibited from selling it to individuals outside the eligible occupational categories. First offenses could result in misdemeanor charges, with subsequent offenses potentially prosecuted as felonies.
The plaintiffs argued that the state’s restrictions prevented law-abiding individuals from acquiring equipment designed to protect them from gunfire. Their lawsuit maintained that the Second Amendment encompasses defensive armor and that New York lacked a sufficient historical basis for excluding ordinary citizens from its protections.
Judge Sinatra agreed, determining that the constitutional meaning of arms extends beyond firearms and other offensive weapons. His opinion examined historical definitions considered by the U.S. Supreme Court in District of Columbia v. Heller, including founding-era language recognizing both offensive weapons and defensive armor.
The court concluded that body armor qualifies as an arm protected by the Second Amendment and that New York failed to demonstrate a historical tradition supporting its restrictions. The ruling also applied the constitutional framework established in New York State Rifle & Pistol Association v. Bruen, the Supreme Court’s 2022 decision requiring firearms regulations covered by the Second Amendment to be evaluated against the nation’s historical tradition of arms regulation.
New York defended its law by arguing that protective armor was not traditionally understood as an arm within the amendment’s meaning and that historical restrictions on armor provided a basis for government regulation. The state also raised concerns involving modern ballistic protection and the potential misuse of protective equipment during violent confrontations.
The court rejected those arguments, finding that historical restrictions cited by the state did not establish a sufficiently comparable American tradition of prohibiting ordinary citizens from acquiring defensive armor. Judge Sinatra also determined that technological improvements in modern protective equipment did not remove it from constitutional protection.
The ruling represents an important development in Second Amendment litigation because it addresses equipment intended to protect against injury rather than a firearm or other weapon used for offensive force. The court’s interpretation recognizes defensive armor as a constitutionally protected category of arms when acquired for lawful self-defense.
The case also involved New York Attorney General Letitia James, State Police Superintendent Steven G. James, Erie County District Attorney Michael J. Keane, and Monroe County District Attorney Sandra Doorley in their official capacities. The court issued a statewide permanent injunction prohibiting the named defendants, their officers, agents, employees, and others acting in concert with them who receive notice of the order from enforcing the challenged restrictions on purchasing and selling body armor. The injunction covers New York Penal Law Sections 270.21 and 270.22, General Business Law Section 396-eee, and associated enforcement regulations, policies, and practices.
The decision does not invalidate separate restrictions governing the wearing of body armor during the commission of certain violent felony offenses. Those criminal provisions remain outside the relief granted in this case.
Although the court granted a permanent injunction, Judge Sinatra also approved New York’s request for a 14-day stay pending appeal. The temporary stay delays enforcement of the injunction, meaning the state’s existing body armor purchase and sale restrictions remain enforceable during that period. Unless an appellate court extends the stay or grants additional relief, the injunction will take effect when the temporary stay expires. The ruling therefore establishes a significant constitutional victory for the plaintiffs without immediately eliminating the restrictions while appellate proceedings remain possible.
The ruling establishes a federal district court judgment recognizing the constitutional protection of defensive body armor, while leaving open the possibility of further proceedings before the U.S. Court of Appeals for the Second Circuit. Its broader legal significance will depend in part on whether the judgment survives appellate review.
For New York residents, the immediate consequence is a judicial determination that the state’s general purchase restrictions violate the Second Amendment, accompanied by a temporary delay in enforcement of the court’s remedy. The case places the constitutional status of defensive body armor at the center of an important legal dispute over the scope of lawful self-defense protections.
Important note: Constitutional rights do not protect themselves. They rely on the vigilance and active engagement of the citizens who hold them. If law-abiding Americans do not stand up to defend their Second Amendment, First Amendment, or any of our protected rights today, they risk watching those rights be legislated out of existence tomorrow. The time to protect lawful ownership is now, because once a fundamental right is surrendered, it is usually never given back.
